by challengers to North Carolina's restrictive voting law was filed 
yesterday. The Supreme Court could act at any time.  We could well hear 
something later today or tomorrow.

This earlier post<http://electionlawblog.org/?p=66256>explained what's 
at stake in this case and the state's position as to why the Supreme 
Court should issue a stay.

The challengers' response essentially makes two points. (1) The 4th 
Circuit properly interpreted and applied the scope of section 2 of the 
Voting Rights Act. and (2) Pointing to statements made to the press by 
some election officials since the 4th Circuit's order restoring same day 
voter registration and out of precinct voting, it will not be a big deal 
to put these laws back into effect so close to the election.

What is most notable about the brief is what it does not say. The key 
issue in this stay decision, I believe, rests on how to read the Supreme 
Court's earlier decision in /Purcell v. Gonzalez/, which cautions courts 
against changes in election law close to an election.  Purcell gets a 
brief mention in the introduction to the brief and then just a single 
paragraph in the body of the brief:

    Third, contrary to Defendants' vague and conclusory allegations
    that enforcing the Fourth Circuit's injunction will cause "voter
    confusion," a stay by this Court is more likely to cause the type of
    confusion this Court sought to avoid in Purcell v. Gonzalez, 549
    U.S. 1 (2006) (per curiam).5 Maintaining the status quo in November
    will not confuse voters, who are accustomed to same day registration
    and out-of-precinct balloting, which have been in effect since 2008
    and 2006 ,respectively. The preservation of these practices will not
    risk "that qualified voters might be turned away from the polls,"
    id. at 4, but rather simply provide a "safety net" with "more
    opportunity to register and vote" such that "voters who are confused
    about whether they can, for example, still register and vote on the
    same day will have their votes counted." Op. at 55 fn. 8. In other
    words, the only ways that SDR and out-of-precinct voting will affect
    the voters is to increase access among the voters who need them,
    without affecting other voters at all. It is for this reason that
    the Fourth Circuit rejected Defendants' complaints about possible
    voter confusion: SDR and out-of-precinct voting simply provide
    voters with more options to ensure that their votes are counted.

    FN 5: In Purcell, the Ninth Circuit overturned the district court's
    denial of a preliminary injunction before the district court even
    issued its opinion. Id. at *3. This Court thus appropriately held
    that the Ninth Circuit could not have paid the proper deference to
    the district court's findings of fact, nor could have concluded that
    the district court erred as a matter of law. Id. at *5 . This case
    could not be more different. The district court issued a detailed
    ruling on August 8, 2014. The Fourth Circuit deferred to all of the
    district court's factual findings, most of which were undisputed.
    And the Fourth Circuit articulated, based on the district
    court's opinion, that at least eight different legal errors that the
    district court made. Op. at 36-45.

    ENOUGH.

    The frustrating thing is that courts understand this when it comes
    to their own operations. For example, in the North Carolina case,
    the federal trial court has been given the signal to hold off on
    issuing any order until the Supreme Court has weighed in, since
    being asked to issue two contradictory orders in a short span of
    days could result in confusion.

    I'd like to see that same theory apply to last-minute election
    litigation generally. As Hasen and others have pointed out --
    repeatedly but so far in vain -- there is precedent (Purcell v.
    Gonzalez <https://supreme.justia.com/cases/federal/us/549/06-375/>)
    suggesting that courts should tread carefully in the run-up to
    Election Day lest the intended benefits of any order be dwarfed by
    the chaos it produces. Courts should heed that advice and look very
    skeptically upon any party or court that tries to force last-minute
    changes to election rules.

    And let's be clear -- both major parties each share the blame. In
    Kansas alone, a last-minute candidate withdrawal by one side
    resulted in a push by the other side to force a new candidate's name
    on the ballot -- which left county election officials scrambling not
    just to prepare, print and deliver ballots to overseas and military
    voters but to be ready for everyone else. [At least they have
    baseball to distract them.

    And Courts of Appeals in Wisconsin and North Carolina have really
    put election officials in a difficult position by ruling so close to
    Election Day that the Supreme Court is being asked to intervene.

Same sex marriage is about to be legal in the state of Utah. Utah! 
  Ponder that for a minute. If you were going to pick one of the very 
last states that would legalize same sex marriage, it would have been 
this conservative state.

The fact that the Supreme Court, without saying a peep, is letting 
court-ordered same sex marriages go forward in Utah is a huge deal. Now 
you may think that this could well be reversed once there is a circuit 
split, perhaps in a case from the 5th or 6th Circuit.  But remember, 
there will now be all of these children from legal same sex marriages 
performed until the Supreme Court could decide to take a case from 
another circuit. The idea that Justice Kennedy would let that happen, 
knowing there could well be a reversal down the line seems unlikely.

Instead, the conservatives on the Court probably see same sex marriage 
as inevitable, and will wait for a circuit split to make their last stand.

As we get into the "silly season" of election administration frenzy, 
it's worth connecting two stories hours apart --- the piece onRomney's 
mistaken registration address <http://electionlawblog.org/?p=66322>to 
the story about GOP scouring of voter rolls in Illinois 
<http://electionlawblog.org/?p=66314>.

The Romney article in the Salt Lake Tribune claims that Romney had filed 
a registration paper "using a home address he couldn't legally claim 
since 2009." The sole reference in the story to the reason he couldn't 
claim that address is that he sold the house in 2009. This is the second 
time

has filed registration paperwork for an address where he wasn't 
apparently actually sleeping.

But there is often an unappreciated difference between someone's legal 
voting address and where they currently sleep

The easiest examples concern deployed military servicemembers.  Voting 
usually depends on domicile --- often, the last place someone lived with 
an intent to remain indefinitely.  Someone on temporary sojourn(s) 
elsewhere may belawfully and appropriately registered at an address they 
left decades ago

  Romney's selling the house in 2009doesn't give enough information to 
knowwhether he could legally claim the address for voting purposes.

Which brings me to theIllinois article

  It states that operatives are "looking for addresses where utility 
service has been cut off to determine if registered voters have moved." 
  That's an indication that registered voters may not be home.  But it 
does nottell you where their legal home is.  And confusing the two gets 
eligible citizens tossed off the rolls.

Following up onthis post <http://electionlawblog.org/?p=66316>, 
challengers to the North Carolina voting rules have filedthis response 
<http://electionlawblog.org/wp-content/uploads/14A358-10-3-Letter-from-Respondents.pdf>opposing 
an interim stay.

Given that it is past 5 pm Friday on the East Coast, election officials 
in NC likely will not do too much over the weekend, and a response is 
already due from the challengers on Sunday, we may not hear anything at 
all until the Chief Justice or the Court rules on the overall stay 
request---perhaps as soon as Monday.

presidential candidate, would be wise to read legally binding documents 
before signing them, as demonstrated by a Utah voter-registration gaffe

If this happened to a Democrat some would call it voter fraud. It is of 
course nothing of the sort.

    North Carolina Asks Chief Justice Roberts for Interim Immediate Stay

This morning I reported onan injunction 
<http://electionlawblog.org/?p=66308>just issued by the federal district 
court in the North Carolina voting case. The injunction was issued while 
the Supreme Court considers a stay of the 4th Circuit's order.

Well the state of North Carolina is not happy that the plaintiffs asked 
for this immediate injunction.They have filed this letter 
<http://electionlawblog.org/wp-content/uploads/nc-letter.pdf>, asking 
the Chief Justice to impose an immediate stay while the Court considers 
what to do with the stay request (response due Sunday at 5). They now 
want the stay to apply not just to the 4th Circuit's order but to the 
new district court injunction.

NC's stay request, which I think has a pretty good chance of being 
granted. An interim order from the Chief Justice could come today, 
although with it already being Friday afternoon on the East Coast 
perhaps this is not really necessary, especially because the district 
court has put implementation of the new injunction on the slow track.
