    Voting Cases on Today's #SCOTUS Agenda

I expect an order from the Chief Justice (or more likely, the entire 
Supreme Court) today inNorth Carolina's attemp 
<http://electionlawblog.org/?p=66363>t to reverse a 4th Circuit ruling 
restoring same day voter registration and out-of-state voting in the 
state for this election. I think it is likely that the Court will stay 
the 4th Circuit's order.

The state of Wisconsin is expected to file by 5 pm today a response to 
amotion by challengers to WI voter id law 
<http://electionlawblog.org/?p=66198>to stop the 7th Circuit's surprise 
order requiring id to be used in this election while the challenge to 
the law remains pending. Justice Kagan 
<http://www.supremecourt.gov/Search.aspx?FileName=/docketfiles/14a352.htm>(or 
more likely, the entire Supreme Court) will act some time thereafter on 
the motion. Wisconsin's case got a boost from a 7th Circuit opinion on 
the merits issued yesterday (which I havesharply criticized 
<http://electionlawblog.org/?p=66413>). I think it is fairly likely that 
the Court will stay the 7th Circuit's order.

What really gets me is how Judge Easterbrook takes a difficult and 
complex issue and gives it the back of its hand---whether it is his 
rejection of the district court's finding that up to 9% of Wisconsin 
voters don't have the right kind of ID for voting or how to apply 
section 2 of the Voting Rights Act to vote denial claims.  It was the 
shortest and most superficial discussion I've seen. Compare it to the 
much more thoughtful (and equally conservative) district court opinion 
in the North Carolina voting case.

    Another Error in Judge Easterbrook's WI Voter ID Opinion

Following up onthis pos <http://electionlawblog.org/?p=66413>t, a reader 
notes that Judge Easterbrook also writes in his opinion today:

    "The Justices observed that a commission chaired by former President
    Carter had recommended the use of photo ID to verify a person's
    entitlement to vote. Commission on Federal Election Reform,/Building
    Confidence in U.S. Elections/18 (2002)."

    First of all, he means the Carter-Baker Commission of 2005 I assume
    [and not the 2002 Carter-Ford report].  And as has been discussed by
    you and others, [it] is a complete mischaracterization [of the
    Carter-Baker report].

Too bad Judge Easterbrook's opinion isnot peer reviewed.
