Veryinteresting. A NC trial courthas found
<http://www.wral.com/judge-orders-county-to-provide-early-voting-site-on-app-state-campus/14074008/>that
the State Board of Elections, ratifying the majority preference of the
Wautauga County Board of Elections (which split along party lines),
intended to discriminate against students in moving an early voting site
half a mile, from the campus of Appalachian State University to a site
in downtown Boone. The short opinion ishere
<http://electionlawblog.org/wp-content/uploads/20141013-NC-early-vote.pdf>.
Even as thewar over North Carolina's new statewide law
<http://electionlawblog.org/?p=66538>rages on, don't ignore the battles
over implementation.

"Mobile ID Stations Canceled" in Texas

I'm not sure how widespread this is, but the Texas Secretary of State's
office hasapparently now canceled some local appearances
<http://amarillo.com/news/local-news/2014-10-13/mobile-stations-cancelled-after-voter-id-ruling>of
mobile stations designed to provide photo ID certificates to those who
can muster the appropriate documents. I wonder how state actions to
curb outreach that provides ID might impact the balance of equities in
appellate review of the district court's order before the election.
After all, the mobile stations wouldn't be necessary if every eligible
voter already had the ID they'd need for the election if the judge's
order were not in place.

Support for ID Varies Based on Race of Imagined Voter

Oof
<http://www.wdde.org/68683-ud-study-examines-role-race-voter-id-debate>.
A new study from the University of Delaware's Center for Political
Communication found that white Americans responded differently in a
survey asking about their opinion of voter ID laws depending on the
race of the person shown in a picture during the survey.
73 percent of white Americans said they support the laws, which
require producing a government-issue ID at polling stations, when
shown a photo of a black voter at a polling station. That's opposed
to 67 percent who said they support voter ID laws when showed a
photo of a white voter and poll worker --- the same percentage
supported the laws when shown no image.

Two press releases from Jim today. Onedescribes
<http://electionlawblog.org/wp-content/uploads/20141013-Ognibene-pr.pdf>arequest
for a trial court to change its mind
<http://www.jamesmadisoncenter.org/cases/files/ognibene-parks/60b-motion.pdf>on
a 2009 decision approving New York City's laws prohibiting contributions
from certain business entities (LLCs, LLPs, and partnerships), and
placing special campaign finance restrictions on lobbyists and those
doing business with the city. The filing cites/McCutcheon/as a reason
to change course.
The otherdescribes
<http://electionlawblog.org/wp-content/uploads/20141013-Prop-8-pr.pdf>Jim's
attempt to return to the Supreme Court on the issue inDoe v. Reed
<http://scholar.google.com/scholar_case?case=8177814012370008221>:
disclosure in the face of threats, harassment, or other reprisals.
In/Doe v. Reed/, the Court rejected a facial challenge to a law
requiring disclosure of signatories to referendum petitions (the
referendum in question involved an expanded domestic partnership law in
Washington State; supporters of the law won the referendum vote). But
SCOTUS set/reaffirmed the legal standard for an as-applied challenge to
particular disclosure laws. Now,in a case involving the contributors to
a PAC supporting California's Prop 8
<http://www.jamesmadisoncenter.org/cases/52-protect-mariage-v-bowen.html>,
Jim is looking for the Supreme Court to reverse two lower courts,
expunge the relevant contribution records, and prevent further disclosure.

In the piece, Bob Bauer gets credit for founding Perkins Coie (he's
wizened, yes, but I'm not sure he was in a position to found much of
anything in 1912). But the thrust of the article --- that Marc is
indispensible to many Democratic campaigns this cycle --- is unimpeachable.
