There's just nine weeks left before the mid-term elections---and
there's more money than ever for Senate and House campaigns. In
April, Alabama businessman Shaun McCutcheon gave his name to a US
Supreme Court decision to eliminate legal restrictions on how much
an individual can give in total to candidates and committees.
McCutcheon says it's great to have more money in politics---putting
it this way: "we're just spreading speech." What's the likely impact
of more money in politics---this year and in years to come?

Taylor issued a statement saying that he had been assured by
Assistant Secretary of State Brad Bryant that his letter was
sufficient. Kobach denied that claim and also contended that Taylor
should have read the statute himself.
"Mr. Taylor is an attorney. He is capable of reading the statute and
the statute is very clear on this point," Kobach said. "And I would
note that many non-attorneys have withdrawn from office in the past
and they have all read the statute and made that declaration."

There are complicated issues about applying waiver and estoppel theories
against the government. But if this ends up in court, I expect this fact
would help an argument for withdrawal greatly.
UPDATE: SOS Kobach says the name stays on the ballot. I expect Dems to
go to court next.

The results are not surprising, but it is not clear if they will be
upheld on appeal. It all turns on what counts as official acts and
corruption under the law. There are vagueness and First Amendment
issues lurking here. The big fight will be in the 4th Circuit.
Today is a bad day for the McDonnells, but they will have serious issues
on appeal which could lead to 4th Circuit reversal.

raises the question whether Democrat Chad Taylor's withdrawal from the
Kansas Senate race is allowed. The relevant statute,KS 25-306b(b)

that a candidate can withdraw within a certain time frame: "Any person
who has been nominated by any means for any national, state, county or
township office who declares that they are incapable of fulfilling the
duties of office if elected may cause such person's name to be withdrawn
from nomination by a request in writing, signed by the person and
acknowledged before an officer qualified to take acknowledgments of deeds."
At issue is the "who declares that they are incapable of fulfilling the
duties of office if elected." Taylor's letterdid not so declare

and it looks like the deadline has passed. Now what?
There do not appear to be any cases construing 25-306b. There is an
attorney general opinion 92-66 (onWestlaw

which reads the statute broadly to allow presidential candidate Ross
Perot to replace his vice presidential candidate on the ballot (even
though the statute on its face did not provide for that). But that 1992
opinion predates the 1997 Kansas amendments

the candidate declaring he or she is incapable of fulfilling the needs.
Nothing on Westlaw explains why the language was written in this way.
So the initial question of whether Taylor's withdrawal is kosher is
going to fall to SOS Kobach, who I expect is likely to give the statute
a narrow textual reading. One question is whether Taylor, now after the
deadline, can amend his letter to include the magic words of inacapability.
This could well end up in court, and I don't have a good sense for how
the courts would rule on this question. It may be that the courts would
give deference to a Kobach decision, especially because time is short.
