I'm soon heading to give theConstitution Day lecture Wednesday at
Bucknell <http://electionlawblog.org/?p=64983>, "One Dollar, One Vote:
Campaign Finance, Equality and the Supreme Court."
Before I go, I will try to live blog the Kansas Supreme Court oral
argument in /Kobach v. Taylor/. We could also see some Supreme Court
action in the 6th Cir. Ohio early voting case and the 7th Circuit
Wisconsin voter id case. If I have not blogged about them, it is
probably because I'm on an airplane or otherwise involved with
Constitution Day activities.
Thanks for your patience.

Ohio Files Merits Brief in 6th Circuit Early Voting Case

You can read the briefhere
<https://s3.amazonaws.com/s3.documentcloud.org/documents/1301953/sixth-circuit-ag-brief-naacp-v-dewine.pdf>.
No word yet that I have seen whether Ohio will go to the Supreme Court
to seek a stay of the district court's order which the6th Circuit denied
on Friday. <http://electionlawblog.org/?p=65407>
AsChris Geidner points ou
<https://twitter.com/chrisgeidner/status/511698957102489600>t, the state
argues, among other things, that judges should not order last minute
changes to how elections are run, the key issue in the 7th Circuit order
to reinstate voter id at the last minutes.

<http://electionlawblog.org/?p=65399>whichdid not even bother
<http://takingnote.blogs.nytimes.com/2014/09/15/a-big-big-mistake-in-voter-id-case/?_php=true&_type=blogs&ref=opinion&_r=0>to
consider or mention the difficulty of rolling out voter id when the
voting process had already started. /
/
Someone wise once said: "Court orders affecting elections, especially
conflicting orders, can themselves result in voter confusion and
consequent incentive to remain away from the polls. As an election draws
closer, that risk will increase." Oh yeah, it was theU.S. Supreme
Court. <https://supreme.justia.com/cases/federal/us/549/06-375/>Why
didn't the Seventh Circuit listen?
Instead we have election officials asping pong balls
<http://electionlawblog.org/?p=65465>and the very real possibility WI
voters will be disenfranchised because they cannot get the right
documents (or the right documents needed to get the right documents) in
time for the imminent election. Even if voter id could be smoothly
implemented in Wisconsin, it should not be done in this irresponsible
way. In Pennsylvania, courts put the state's voter id on hold when the
state could not demonstrate it could get ids into the hands of voters
who wanted them in time. Here, there's no chance it can be done in time.
