“How to Save the Voting Rights Act”

In 2010, the/Simpsons/featured a news helicopter

with the logo: “FOX News: Not Racist, But #1 with Racists.” That
slogan might be applied to today’s Republican Party, which in recent
years has actively passed voting laws that make it harder for poor
and minority voters to vote. Whether to label the Republican Party
“racist” isn’t an academic exercise. The question is actually at the
heart of lawsuits over the future of voting rights in Texas and
North Carolina. It’s also a question with historical resonance,
particularly on the eve of the Voting Rights Act’s 50^th anniversary
this week.
The five-decade history of the Voting Rights Act is told masterfully
in Ari Berman’s new book,/Give Us the Ballot: The Modern Struggle
for Voting Rights in America/

starts around the time of the Selma, Alabama, marches, but unlike

rights protections in 1970 and 1975 to include Latinos, Native
Americans, and others over the objections of racists, many in the

Voting Rights Act, providing additional protections for minority
voters nationally, and (now Chief Justice) John Roberts’ key role
for the Reagan administration in unsuccessfully fighting against the
expansion; hot disputes over voting rights in Florida in the 2000
election; the controversial renewal of the expiring “preclearance
provisions” of the act in 2006 that continued to require states with
a history of discrimination to get federal approval before changing
their voting laws; and the ongoing “voting wars

Rights Act, views the struggles over voting rules primarily through
the lens of race. And although that is an essential lens to apply,
it downplays the growing role of partisan politics in this story, a
partisan struggle that is having profound ramifications for the
newest wave of court cases involving voting restrictions. Put
simply, the Republican Party has reasons unrelated to racial animus
to push new voting restrictions.

Republican Party of Louisiana v. FEC. This is a major challenge, filed
by Jim Bopp, raising not just as applied challenges, but facial
challenges to the rules which limit how much money political parties can
raise and from whom. And it has a real chance to succeed/if/the Supreme
Court decides to weigh in. Much will depend upon whether the D.C. court,
where this case is filed, convenes a three-judge court. If so, that
means the case would come to the Supreme Court on a direct appeal and it
is much more likely the Court will hear the case.
There have been two other attempts since the Roberts Court came into
being. First the Court turned away an “as applied” challenge over the
dissent of three Justices. Republican Nat’l Comm. v. FEC, 698 F.Supp.2d
150 (D.D.C. 2010) (three-judge court),/aff’d/, 561 U.S. 1040 (2010). The
case raised an as-applied challenge to the soft money provisions of
BCRA, and did not ask for the soft money part of/McConnell/to be
formally overruled. Justices Kennedy, Scalia and Thomas stated that they
would have noted probable jurisdiction and set the case for oral
argument./See also/Cao v. FEC, 619 F.3d 410 (5th Cir. 2010), cert.
denied 562 U.S. 1286 (2011) (rejecting certain challenges to BCRA
political party limitations).
Then, the Republican Party and Libertarian parties voluntarily dismissed
cases brought, seeking a three-judge court. But then the parties,
without explanation,dismissed the suit.

So it is unclear why that suit got dismissed and this one got filed. It
may be because the Wagner v. FEC case makes it easier to get three-judge
courts in BCRA case.
In the /McCutcheon/case of 2014, Chief Justice Roberts added language
which seemed to invite a challenge

the soft money rules:
“When donors furnish widely distributed support within all
applicable base limits, all members of the party or supporters of
the cause may benefit, and the leaders of the party or cause may
feel particular gratitude. That gratitude stems from the basic
nature of the party system, in which party members join together to
further common political beliefs, and citizens can choose to support
a party because they share some, most, or all of those beliefs. … To
recast such shared interest, standing alone, as an opportunity
for/quid pro quo/corruption would dramatically expand government
regulation of the political process.”
This is a big one.

the National Constitution Center’s Constitution Daily. It begins:
Fifty years ago this week, President Lyndon Johnson signed the
Voting Rights Act, one of the most important pieces of civil rights
legislation in the United States. The Act immediately boosted the
voter registration rates of African-American voters in the South,
who suffered decades of official discrimination in voting well after
the passage of the Fourteenth and Fifteenth Amendments, which
legally barred such discrimination. Later, as the federal government
enforced the Act, and as Congress repeatedly renewed and
strengthened it, the number of minority elected officials soared,
and turnout rates continued to grow. Today, however, as some states
pass new, restrictive voting laws, the Act’s continued vitality and
relevance is in serious question, as the Supreme Court cuts back on
the Act and as Congress fails to respond.

The Democratic Governors Association is creating a fund dedicated to
winning races in states where governors have some control over
congressional redistricting, the party’s first step in a long-range
campaign to make control of the House more competitive.
Billed as “Unrig the Map,” the effort will target 18 of the 35
states in which governors play a role in redistricting, and where
new congressional maps could allow Democrats to win House seats that
are now drawn in a way to favor Republicans. The fund will be used
for governors’ races over the next five years, leading up to the
2020 census.

million over two years, with the two entities most directly involved
in the 2016 elections, Americans for Prosperity and a super PAC,
planning to spend $325 million through Election Day.

House Republican leaders are slamming the brakes on voting rights
legislation, insisting that any movement on the issue go through a
key Republican committee chairman who opposes the proposal.
House Democrats are pressing hard on GOP leaders to bring the new
voter protections directly to the floor.
That would sidestep consideration in the House Judiciary Committee,
where Chairman Bob Goodlatte (R-Va.) has rejected a bipartisan
proposal to update the 1965 Voting Rights Act (VRA) in the wake of a
2013 Supreme Court decision that gutted a central provision of that law.
Speaker John Boehner (R-Ohio) and other Republican leaders say the
bill must go through Judiciary.

anniversary of VRA) goes to the top of my reading list. Here is the
abstract:
The fiftieth anniversary of the Voting Rights Act comes at a
difficult juncture. The Supreme Court’s decision in Shelby County
dismantled the core preclearance provisions of what had been the
most successful civil rights law in American history. At the same
time, the right to cast a ballot free of unnecessary legal
encumbrances is more contested than it has been in generations. Yet,
the story is more complex. The landscape of voter discrimination
today bears little resemblance to the formalized Jim Crow barriers
to the black franchise. Even before Shelby County, the Voting Rights
Act struggled to keep up with the new voting challenges, which have
evolved from exclusively Southern obstacles defined by race to
nationwide electoral modifications with at best limited evidence of
direct racial motivation. The narrow geographic confines of Section
5 of the Voting Rights Act were largely supplanted by other legal
protections of the right to vote, well before Shelby County.
This Article turns to other legal tools that have been invoked since
1965 to address voting claims outside the purview of Section 5. The
claim is that more generalized protection of the franchise can
better respond to the more fact-laden challenges presented by more
contemporary voting rights claims. The Article draws on personal
experiences with four voting cases that rely on tools ranging from
Section 2 of the Voting Rights Act to the Constitution to the common
law to address claims that fall outside the domain of Section 5.
These cases illustrate the way in which a more general framework for
voting rights protection can be used to tackle electoral schemes
that were neither subject to Section 5’s technical scrutiny, nor
were Southern, racially specific, or even institutional in nature.
