After reading the Appellants Opposition to motion to dismiss or affirm, I'm
now wondering if the court is just tired of this being raised and will take
this opportunity to say definitively that population equality meets the
equal protection requirements, regardless of whether there are other
measures that would also meet the requirement. In other words, that voters
do not have any separate equal protection claims beyond those of "any
person". Since this is an appeal of a dismissal rather that a cert petition
(which is how it is different from Irving) it might have looked like a good
time to do that.
