State discrimination laws protecting all off-duty "lawful activity"
provided it does not directly impact the employer's core business interests
are being interpreted to protect speeches and political activity and
affiliation in states like Colorado and North Dakota. In general, "lawful
acitivty" anti-discrimination statutes have also been called anti-lifestyle
discrimination statutes, because they may also be interpreted to protect
those choices as well.
