Subject: ELB Listserv Inquiry

Hi Mr. Rick Hasen,

My name is Mohamed Aziz, and I am a legal fellow at FairVote. I am looking to submit a listserv inquiry as follows:

"I’m working on a project for FairVote assessing the value of pursuing changing election laws to improve our political system in state courts (as opposed through new statutes, ballot measures or federal cases). I am writing to ask if list members know of examples of successful or instructive lawsuits brought in state court under state law that argued for changes in election law.

It seems interesting to us that many ambitious legal theories -- for example, groundbreaking challenges to laws which prohibited same-sex marriage -- were successful in state courts first, yet it seems like comparable election law challenges have gone straight to federal court. For example, have there been challenges to gerrymandering brought based on a state constitution’s equal protection clause or right to vote clause? Or challenges to how primary elections are conducted?

If anyone else has information about election law challenges in state court under state law, I’d appreciate a reply off list."

Thank you very much for your assistance, and please let me know if there is anything else you need from me in order to ensure that this inquiry is posted.

Kind Regards,

Mohamed
