[EL] troubling

I can't speak for Rick, but what I found "troubling" was the following recitation of the FEC's inability to deal with the matter in a timely manner, and the refusal of three Commissioner's to authorize a request for  the information they clearly needed to pursue the investigation . What a sorry tale of FEC malfunction. (My apologies  for the inexpert copying and pasting from the Weintraub Statement of Reasons, but I believe it is readable!)

I am honestly curious as to what is "troubling" in the item below. Is it that respondents have chosen to exercise their right to contest the Commission's finding in court? Is it troubling that they might win? Is it troubling to preserve their asserted right during the period that they are challenging the Commission in court (thus preventing the irreparable harm they claim would result, and avoiding mooting the case?  Is commissioner weintraub's rather grandstanding cover "troubling"? Or her apparent resentment at the respondents for daring to challenge the commission?

It seems to me that what would be troubling would be the denial of constitutional minimums of due process. The FEC's statutory enforcement process does not meet that constitutional norm, which is why Congress allowed respondents to litigate in court.

Due to pending litigation, I must take the unprecedented step of releasing the attached statement with the identities of certain persons and entities redacted. As can be seen from my statement and the third General Counsel's Report, these were not incidental witnesses swept up in the agency's probe, but rather key players in the scheme the Commission unanimously found to have violated the law against making contributions in the name of another.
After engineering an intricate plot to defeat the public's interest in knowing who was actually behind a $1.7 million political contribution, the plaintiffs are now taking the extraordinary step of suing the Commission to force us to continue to hide their identities.1 I am looking forward to the expeditious resolution of this litigation with a ruling in the FEC's favor that will allow me to reissue my statement unredacted.
The public has the right to know as much as this agency was able to determine about who was trying to influence the election with this huge contribution. Likely the beneficiaries of their largesse already do.
