On Friday, all of Alabama’s 67 counties were required to officially file their election results to the secretary of state’s office. In a statement, Secretary of State John H. Merrill said his office plans to officially certify the election on Dec. 28.
Also Friday, some of the names left on thousands of write-in ballots began to emerge. Some names are surprising. Who knew SpongeBob SquarePants had a constituency?…
In several counties, Mickey Mouse and SpongeBob SquarePants appeared on ballots. Phil Robertson, star of the television series “Duck Dynasty,” received votes in at least 10 counties. Another popular choice was simply the word “anybody.”
But the candidates to receive the most write-ins were mostly seasoned politicians and public figures.
Sen. Luther Strange, who lost to Moore in the Republican primary, netted 5,822 write-in votes, according to AL.com. Lee Busby, a retired Marine who launched his write-in campaign as Moore’s sexual misconduct allegations emerged, raked in nearly 3,600 votes.

The United States opposes private plaintiffs-appellees’ motion to lift the stay pending appeal that the motions panel entered on September 5, 2017. The parties’ merits briefs and oral argument before this Court only reinforce the strong likelihood that Texas will succeed in showing that the district court legally erred and abused its discretion in permanently enjoining Senate Bill 5 (S.B. 5), the State’s amended photo ID law. The balance of equities and the public interest also strongly favor leaving the stay in place. Accordingly, this Court should deny the motion.
The U.S. is still nominally a plaintiff in these cases, but it is functioning as a friend of Texas in supporting its appeal.

How much does law matter in election cases where the partisan stakes are high? At first glance, election cases may seem the worst context for studying the influence of law on judicial decisionmaking. Election cases, which typically decide the applicable rules for a given election, often determine election outcomes and therefore feature high political stakes in the balance. But we argue that election cases offer a unique opportunity to study the role of law in judicial decisionmaking precisely because we can assume partisanship influences judges in these cases.
If judges prefer to decide election cases consistent with their partisan interests, then they may decide these cases contrary to partisan interests mainly when the out-party litigant’s case has strengths sufficient to overcome this usual, countervailing influence of partisan loyalty. For this reason, we use lower court judges’ decisions contrary to their partisan interests as a proxy for underlying case strength. We find that our measure of case strength is predictive of state supreme court decisionmaking in these election cases on appeal. State supreme court justices from both parties are most likely to affirm when case strength is indicated by our measure. This is particularly true when case strength aligns with a justice’s partisan interests such that both law and partisanship direct the same result on appeal, but even when case strength conflicted with a supreme court justice’s partisan loyalty, case strength won out most of the time. Our other results suggest that where case strength could not be inferred by the lower court disposition, partisanship generally predicted quite a bit, with interesting complications that we explore.

A federal judge on Thursday dismissed a lawsuit brought by one of the organizations claiming that President Trump’s continued ownership of his businesses create conflicts of interest that violate the Constitution.
The judge, US District Judge George B. Daniels, also ruled that it is up to Congress to decide whether there are any valid concerns raised by foreign governments doing business with Trump’s businesses and, if so, what to do about those concerns.
The lawsuit was brought<https://www.buzzfeed.com/chrisgeidner/top-legal-ethics-scholars-to-file-first-major-lawsuit-agains?utm_term=.nhxmde0MD#.uiz01r6bg> in New York by Citizens for Responsibility and Ethics in Washington (CREW) in the first weekend of the Trump administration. Since then, a restaurant employees association and other hospitality industry-related individuals joined the lawsuit.
In the 29-page decision<https://www.documentcloud.org/documents/4335155-CREW-v-Trump-Decision.html>, however, Daniels dismissed their case — which alleged that Trump’s continued interests in his businesses are leading to violations of the Domestic and Foreign Emoluments Clauses — ruled that they lack standing to bring the lawsuit.

Following a federal push for more disclosure, and amid investigations into Russian meddling into American elections, Gov. Andrew M. Cuomo is proposing legislation to close legal loopholes in New York regarding political ads on the internet, with the goal of pressuring companies like Facebook to root out foreign-based interlopers in online campaigns.
The proposal, announced on Thursday and due to be introduced to the Legislature early next year, closely hews to a federal bill<https://www.warner.senate.gov/public/index.cfm?p=the-honest-ads-act> introduced in October by a pair of Democratic senators — Mark Warner of Virginia and Amy Klobuchar of Minnesota — and Republican Senator John McCain of Arizona. That bill, the Honest Ads Act<https://www.congress.gov/bill/115th-congress/senate-bill/1989/text>, would require internet companies to reveal who is paying for political advertising on their sites by amending federal election law, which dates to the early 1970s, to include “paid internet or paid digital communication.” Print, radio and television are already subject to such regulations.
