Putting aside whether perjury could be proven<https://www.washingtonpost.com/news/politics/wp/2017/03/02/could-sessions-face-perjury-charges-former-federal-prosecutors-think-not/?hpid=hp_hp-top-table-main_sessionsreax-desktop-tab%3Ahomepage%2Fstory&utm_term=.fd07430338ac> against AG Sessions, there’s another possible hurdle: the Speech or Debate Clause, which gives members of Congress immunity from criminal prosecution for certain legislative acts, for example a speech on the Senate floor.
Would a sitting Senator testifying as an executive nominee get the benefit of the Speech or Debate Clause. Josh Chafetz suggests yes<https://twitter.com/joshchafetz/status/837332497667088384>, though I’d like to see more analysis.

The Campaign Legal Center and Common Cause filed a complaint<http://www.campaignlegalcenter.org/document/fec-complaint-trump-filed-false-campaign-report-violation-election-law> with the Federal Election Commission alleging Donald Trump’s campaign committee violated federal election law by illegally accepting campaign contributions after Election Day and falsely reporting those contributions for “debt retirement,” even though no debt existed. These false reports could have the effect of illegally increasing the amount Trump could accept from contributors for his 2020 reelection campaign.
