Secretary of State Kris Kobach won the Republican nomination for Kansas governor Tuesday after Gov. Jeff Colyer conceded following a week of stunning twists in the razor-thin contest.
The concession came after Kobach widened his lead to more than 300 votes with the counting of provisional ballots in Johnson and Sedgwick counties. Johnson County had been seen as a bulwark in Colyer’s effort to overtake Kobach.
Colyer conceded in an evening news conference from the Statehouse, where he said he wouldn’t ask for a recount or challenge the election results in court….
Colyer no doubt concluded the election was beyond the margin of litigation<https://papers.ssrn.com/sol3/papers.cfm?abstract_id=698201>. But the many flaws in Kansas’s election system—especially unclear rules about the treatment of certain provisional ballots and the conflict of interest in the system—were exposed by the contest.

Ohio’s secretary of state subtly condemned the right-wing websites, including Breitbart<https://www.breitbart.com/big-government/2018/08/08/expert-170-registered-voters-in-ohios-12th-district-listed-as-over-116-years-old/>, that published stories last week alleging that 170 listed registered voters in the state’s 12th Congressional District were over the age of 116.

The Brennan Center and Democracy North Carolina today filed a friend-of-the-court brief<https://www.brennancenter.org/legal-work/cooper-v-berger> to stop North Carolina’s legislature from using misleading language on two ballot initiatives to amend the state constitution. The proposals going before voters this fall would substantially reorganize state government in favor of the GOP-dominated legislature, which has repeatedly engaged in gerrymandering and other anti-democratic tactics to cement the majority party’s power.
One amendment would give the North Carolina General Assembly the power to appoint all members of the state election board, other state boards, and commissions currently chosen by the governor, while the other would allow the legislature to fill judicial vacancies with political appointees. Both measures would consolidate power with the current Republican majority against future losses in voter support.

Now that chaos has arrived, in the very election that will determine Kobach’s political future. The Aug. 7 primary between the secretary of state and incumbent Republican Gov. Jeff Colyer remains too close to call due to election-day errors that left thousands of ballots in limbo. For years, the state GOP allowed Kobach to abuse the powers of his office for political gain while failing to perform basic duties. This is a BFD. The GOP-controlled legislature dragged its feet forvmonths on impeaching these justices to prevent their replacement by voters via special elections this fall. Missing today's deadline lets Republican Gov. Jim Justice appoint their replacements.
