The justices’ crime? Striking down the state’s gerrymandered congressional maps<https://thinkprogress.org/breaking-pa-scotus-republican-gerrymander-671163474bb1/>, which allowed Republicans to win 13 of the state’s 18 congressional seats even in election years when Democrats won a majority of the statewide popular vote.

The Ohio Senate on Monday passed a bipartisan proposal to change how Ohio draws its congressional districts, advancing the proposed constitutional amendment one step closer to appearing on the May ballot.

Advocates for redistricting reform say the proposed changes will curb the legislature’s ability to gerrymander districts to favor a political party or incumbent.

The Senate approved a revised Senate Joint Resolution 5<https://www.legislature.ohio.gov/legislation/legislation-summary?id=GA132-SJR-5> in a 31-0 vote. The House will vote on the resolution Tuesday, one day before the deadline to place a measure on the May ballot.

Breaking: Justice Alito Denies Emergency Stay in Pa. Congressional Districting Case<http://electionlawblog.org/?p=97340>

I called it a long shot,<http://electionlawblog.org/?p=97047> but had doubts when Justice Alito delayed things and asked for a response, but now the Justice has denied the reques<https://twitter.com/brkend/status/960571669176832000>t without referring it to the full court.

Failure to refer usually means the Justice has calculated that the other Justices would not be likely to grant a stay. It is very unusual for these measures not to be referred, but I’m guessing Justice Alito knows that if he was not convinced, the chances of getting to five were very small.

Still pending is the stay request in the North Carolina racial gerrymandering case. But the PA case has more national implications.

Justice Alito’s denial of the stay in the Pa Congressional redistricting case is a reminder that it is NOT all partisan politics at the Court. If it were, surely J. Alito would have ruled to help Republicans in their Pa House races in 2018.
