In Fitzgerald v. Alcorn, the Western District of VA struck down part of the
Virginia Code that gave incumbents the right to choose the method of their
renomination. It was unabashedly referred to as the "Incumbent Protection
Act." The court spend most of the time discussing standing to sue.
In the end, the case has importance for the associational rights of
political parties and how scholars envision the relationship between what
V.O. Key referred to as the party organization and the
party-in-the-government.
