Chris Gober and I won an appeal in the 8th Circuit.

Thanks to the Bopp Law firm for teeing up the issue 15 years ago, or so ... but were bounced on ripeness grounds.

A more developed record in the intervening years allowed the appeal to proceed.

Merits: Requirement that a ballot issue committee “form” thirty days prior to the election for which the committee accepts contributions or make expenditures is unconstitutional... particularly as the scheme elsewhere had registration and reporting requirements, and a treasurer appointment provision ... and required each committee to terminate after each election... or retire debt ... but, in any case, not speak after the election ... until it could form anew for a subsequent election.
