“Justice Department changing lawyers on census case”<https://electionlawblog.org/?p=106117>
Posted on July 8, 2019 8:30 am<https://electionlawblog.org/?p=106117> by Rick Hasen<https://electionlawblog.org/?author=3>

WaPo:<https://www.washingtonpost.com/world/national-security/justice-department-changing-lawyers-on-census-case/2019/07/07/18ba6650-a112-11e9-b732-41a79c2551bf_story.html?utm_term=.19f4c4b5cda0>

he Justice Department is swapping out the lawyers who had been representing the administration in its legal battle to put a question about citizenship on the 2020 Census, possibly signaling career attorneys’ legal or ethical concerns over the maneuvering ordered by President Trump.
The department announced the move in a statement, which was issued after The Washington Post inquired about whether the career lawyers on the team planned to withdraw. A person familiar with the matter, who spoke on the condition of anonymity to discuss internal deliberations, said that at least some of the career attorneys harbored concerns about the administration’s handling of the case — although the nature of those concerns and how widespread they were could not immediately be learned. …

The shift in lawyers will be reflected in simple withdrawal and appearance notices filed in court, a Justice Department official said. The official said the entire team on the case — both those in political positions and career employees who have served multiple administrations — will be replaced with political and career lawyers from the department’s Civil Division and Consumer Protection Branch. Several career members of the team declined to comment to The Post.

“Kobach appears to launch Kansas Senate bid by misspelling own name on federal form”<https://electionlawblog.org/?p=106115>
Posted on July 8, 2019 8:27 am<https://electionlawblog.org/?p=106115> by Rick Hasen<https://electionlawblog.org/?author=3>

KC Star:<https://www.kansascity.com/news/politics-government/article232398882.html>

Kris Kobach appears to be running for U.S. Senate and to have launched his campaign by misspelling his own name.

A campaign committee named Kobach for Senate filed with the Federal Election Commission Monday morning, hours before Kobach was scheduled to give a speech in Leavenworth, where he is expected to kickoff his campaign.<https://www.kansascity.com/news/politics-government/article232385337.html>

But the FEC filing initially spelled the former Kansas secretary of state’s name as “Chris<https://docquery.fec.gov/pdf/150/201907089150452150/201907089150452150.pdf>,” an inauspicious start to his campaign to replace retiring Republican Sen. Pat Roberts.

Danedri Herbert, who served as Kobach’s spokeswoman during his campaign for governor, said she could not confirm whether the event in Leavenworth at 1 p.m. <https://www.kansascity.com/news/politics-government/article232385337.html> would be a campaign launch as has been speculated by Republicans from Topeka to Washington.

She also said she couldn’t confirm whether the FEC filing was for the former secretary of state. Kansas saw a congressional race last year between Ron Estes and Ron Estes, so the misspelling caused confusion.

This development is ominous.
It almost certainly means the career attorneys working for the Department of Justice refused to go along with what Trump wants to do now with the citizenship question on the census. https://twitter.com/DelWilber/status/1148019705329967104 …<https://t.co/sWmE0Rd4Iy>

This is particularly perilous situation for govt lawyers who want to protect their integrity and reputation. Not only are they likely going to be asked to make ludicrous arguments on the merits, they probably will have to mislead about what they said before and why they said it.

This is really intriguing. Looks like maybe the leadership of DOJ Federal Programs (which usually would have representation here) declined to go along with this farce, but Consumer Protection Branch (!) volunteered to take over. https://twitter.com/ZoeTillman/status/1148026606352572419 …<https://t.co/m5lYme4rae>

Per a DOJ official (declined to be ID'd), the new team in the census litigation will include a mix of political appointees and career lawyers, drawing more from the Consumer Protection Branch, as opposed to Federal Programs.
