In Harris v. Arizona Independent Redistricting Commission, the Supreme Court held that “those attacking a state-approved plan must show that it is more probably than not that a deviation of less than 10 % reflects the predominance of illegitimate reapportionment factors.”
Is partisan gerrymandering still an illegitimate reapportionment factor after Rucho?
