[EL] Breaking: Supreme Court in Census Citizenship Case Adds Constitutional Question (Enumeration Clause) to the Ongoing Briefing in the Case

The brief can be quite short. Other than the frequency of the census,
the enumeration clause was superseded in large part by the first
sentence of the 2nd clause of the 14th amendment:
"Representatives shall be apportioned among the several States according
to their respective numbers, counting the WHOLE NUMBER OF PERSONS in
each State, excluding Indians not taxed. "
While it is true that the rest of the clause formulates a remedy to
punish states denying the right to vote of a substantial portion of male
"persons" who are citizens (by reducing the state's representation in
the House), there is no safe harbor afforded by the 14th Amendment's
modification of the enumeration clause for the Federal Government if it
fails through artifice to count ALL PERSONS for purposes of apportioning
the House of Representatives.
