True, but we should not lose sight of some racial and partisan disparities as I noted in my forthcoming Three Pathologies piece in ELJ:


As a political matter, the Wisconsin Legislature’s

refusal to delay the election backfired: Democrats

were angry about the attempt to make it harder to

vote, and the party mobilized to request absentee

ballots (Pildes and Stewart 2020). This was true

even though turnout among minority voters was

down: In Milwaukee, ‘‘[w]hile white wards had an

average of 49 percent voter turnout, Black and

Hispanic wards had an average of about 18 percent

turnout’’ (Banerjee and Gall 2020). Some Republican

voters found the absentee ballot request process

difficult,6 and turnout among that group was down

much more than among Democrats,7 leading to

the election of the Democratic-preferred candidate

for the state Supreme Court.

It is a fascinating conversation, and I do applaud the Wisconsin Election Board for all of their outside-the-box thinking that was employed during the primary (enrolling their ~2000 Election Officers in RAVE alerts to update them on the back and forth decisions from the courts, employing the National Guard as poll workers and to deliver ballot envelopes, utilizing personal spray bottles since they couldn’t buy empty ones to put in the sanitizing spray that breweries were making for them, etc).

However, I am curious about the “historically high” turnout that is mentioned by Richard Pildes, as the following article from NPR (https://www.npr.org/2020/04/15/834037566/in-the-end-the-voters-responded-surprising-takeaways-from-wisconsin-s-election<https://urldefense.proofpoint.com/v2/url?u=https-3A__www.npr.org_2020_04_15_834037566_in-2Dthe-2Dend-2Dthe-2Dvoters-2Dresponded-2Dsurprising-2Dtakeaways-2Dfrom-2Dwisconsin-2Ds-2Delection&d=DwMGaQ&c=slrrB7dE8n7gBJbeO0g-IQ&r=v3oz9bpMizgP1T8KwLv3YT-_iypxaOkdtbkRAclgHRk&m=PiNgsUNMTS42XA4mDi9cyN-_dV2BWhv1gMJpIYhkQgE&s=2y1yehspzcr1AO5-Nz-JxmEkjFJ78FYE4CwR4-BI0Rw&e=>) shows that the turnout was generally steady with past elections. What was significant was the uptick in absentee voting (no surprise there). Usually it was ~15%, and for this election it was 71%. I can only hope that states that have not been used to higher absentee ballots are adjusting ballot envelope orders accordingly, and adjusting their procedures, since it is far too late/expensive to update their ballot sorting/scanning technology)

However, all of this makes me very glad that I work in an already fully vote-by-mail county, as we dealt with these growing pains back in 2018.

I look forward to reading about how their August Partisan Primary went, as I haven’t seen articles flying left and right all over my newsfeed.

The U.S. Postal Service has warned Michigan Secretary of State Jocelyn Benson that mail delivery timelines pose ?significant risk? to ballots sent too close to Election Day and that could lead to their disqualification.

USPS General Counsel Thomas J. Marshall wrote to Benson that Michigan election laws and certain deadlines for requesting and casting mail-in ballots are ?incongruous? and ?incompatible? with the Postal Service?s delivery standards.

The Trump campaign, the Republican National Committee and other GOP groups filed the lawsuits Wednesday against elections officials in Linn and Johnson counties.

At issue are absentee ballot request forms that the counties are sending to registered voters with personal information already filled in, including their names, dates of birth and voting pin numbers. Voters just have to review, sign and return the forms to get ballots in October that they can mail back or drop off, avoiding crowded polling places.

Iowa Secretary of State Paul Pate, a Republican, last month told auditors in an emergency election directive that request forms mailed to voters must be blank in order ?to ensure uniformity.?

Pate?s office has not taken any legal action to block the two counties? mailings but said Thursday it is investigating their actions. Pate said that sending forms pre-filled with personal identifying information will give critics of absentee voting ?an opportunity to question the validity of election results in those counties.?

Ms. Duckworth was regarded by Biden advisers as among the candidates likeliest to help him achieve a smashing electoral victory in November. But legal advisers to the campaign expressed urgent concern that Ms. Duckworth could face challenges to her nomination in court: She was born overseas, to an American father and a Thai mother. White House economic adviser Larry Kudlow on Thursday labeled voting rights funding a ?really liberal left? wish list item, slamming congressional Democrats for their coronavirus relief package demands.

The comments from a top administration official came hours after President Donald Trump explicitly tied blocking funding for the U.S. Postal Service to stopping universal mail-in voting during November?s election.

During an appearance on CNBC, Kudlow championed Trump?s recent executive orders aimed at easing the economic burden of the pandemic and criticized Democrats for failing to reach a deal on a legislative package.
