Breaking with President Trump’s drive to overturn his election loss, Senator Mitch McConnell of Kentucky on Tuesday congratulated President-elect Joseph R. Biden Jr. on his victory and began a campaign to keep fellow Republicans from joining a doomed last-ditch effort to reverse the outcome in Congress.
Although Mr. McConnell waited until weeks after Mr. Biden was declared the winner to recognize the outcome, his actions were a clear bid by the majority leader, who is the most powerful Republican in Congress, to put an end to his party’s attempts to sow doubt about the election.
He was also trying to stave off a messy partisan spectacle on the floor of the House that could divide Republicans at the start of the new Congress, forcing them to choose between showing loyalty to Mr. Trump and protecting the sanctity of the electoral process….
A short time later, on a private call with Senate Republicans, Mr. McConnell and his top deputies pleaded with their colleagues not to join members of the House in objecting to the election results on Jan. 6, when Congress meets to ratify the Electoral College’s decision, according to three people familiar with the conversation, who described it on the condition of anonymity.
A small group of House members, led by Representative Mo Brooks of Alabama, plans to use a constitutional process to object to the inclusion of five key battleground states that day<https://www.nytimes.com/2020/12/13/us/politics/trump-allies-election-overturn-congress-pence.html>. There is almost no chance they will succeed. But if they could persuade at least one senator to join them, they could force a vote on the matter, transforming a typically perfunctory session into a bitter last stand for Mr. Trump….
Though he never repeated them, Mr. McConnell had allowed Mr. Trump’s false allegations of election fraud and fantastical claims that he had been the true winner to circulate unchecked for more than a month, defending the president’s right to challenge the election outcome in court. Allies insisted privately that he would ultimately honor the results, but did not want to stoke a year-end conflict that could hurt the party’s chances in two Georgia Senate runoffs and imperil must-pass legislation….,
Mr. Trump himself showed no signs of backing down, repeating his false allegations on Twitter<https://twitter.com/realDonaldTrump/status/1338871862315667456> just after Mr. McConnell spoke: “tremendous evidence pouring in on voter fraud.” Mr. Trump also shared a news article about Mr. Brooks’s efforts, raising the possibility that he could begin pressuring members of the party to join in, stoking an even bigger fight in the weeks ahead.

A Republican state senator in North Carolina is doubling down after making comments on social media paraphrasing a retired general who called on President Trump<https://thehill.com/people/donald-trump> to invoke the rarely-used Insurrection Act and suspend civil liberties such as habeas corpus.
State Sen. Bob Steinburg (R) reportedly called for the president to invoke the act and declare the results of the 2020 election invalid in a Facebook post paraphrasing Air Force lieutenant general Thomas McInerney (ret.), writing: “President Trump must declare a national emergency,” adding that “Trump should also invoke the Insurrection Act.”
In an interview with Raleigh news station WRAL, Steinburg said initially that he was “putting out there options that others say still remain on the table,” and was not endorsing the plan, though he reportedly added later in the interview that he would be on board with such an idea.

Sidney Powell<https://www.nytimes.com/article/who-is-sidney-powell.html>, a lawyer who was part of President Trump’s legal team, spread a conspiracy theory last month about election fraud. For days, she claimed that she would “release the Kraken<https://www.nytimes.com/2020/11/17/technology/release-the-kraken-a-catchphrase-for-unfounded-conspiracy-theory-trends-on-twitter.html>” by showing voluminous evidence that Mr. Trump had won the election by a landslide.
But after her assertions were widely derided and failed to gain legal traction, Ms. Powell started talking about a new topic. On Dec. 4, she posted a link on Twitter with misinformation that said that the population would be split into the vaccinated and the unvaccinated and that “big government” could surveil those who were unvaccinated….
Ms. Powell’s changing tune was part of a broader shift in online misinformation. Three of the seven, Reps. Aides to the four others, Reps. John Joyce, Mike Kelly, Guy Reschenthaler, and Glenn Thompson, did not respond to emails and phone calls Monday and Tuesday requesting comment.
None formally acknowledged what the Electoral College confirmed and has been clear for weeks: that Biden won. Representatives from the campaigns of Republican James “Jimbo” Williams, who was defeated in the race for state Senate District 28, and Republican Tom Shelley, who lost the Grant County Commission District 5 race, began Monday to inspect Grant County ballots and other voting materials impounded by court order at their request earlier this month.
In addition to votes in those two candidates’ races, their campaign representatives were also instructed to count ballots for the presidential election — which was certified by Electoral College voters in New Mexico and nationwide Monday.
According to an order from District Court Judge Jarod Hofacket, candidates and their representatives have the ability to inspect and duplicate all impounded ballots and ballot materials, including tally sheets, provisional ballots, accepted and rejected mail-in ballots, envelopes from mail-in ballots and absentee and mail-in ballot registers.
“I mean, they are looking at the actual ballots, so all the races are on there,” said Grant County Clerk Marisa Castrillo.
In addition to designees of the Republican candidates, representatives for the Democratic Party and the campaigns of Sen.-elect Siah Correa Hemphill and incumbent Commissioner Harry Browne were present during the inspection, as well as Castrillo and a staff member from her office.
With the help of the Republican Party of New Mexico, Donald Trump’s campaign also filed a lawsuit Monday against the New Mexico Secretary of State’s Office, alleging the state violated both federal and state law by allowing the use of drop boxes for voters to turn in absentee ballots.

A former Houston Police Department Captain was arrested and charged for running a man off the road and pointing a gun at his head in an attempt to prove claims of a massive voter fraud scheme in Harris County, according to a news release from the Harris County’s DA’s office.
Mark Anthony Aguirre, 63, was arrested by Houston police Tuesday and charged with aggravated assault with a deadly weapon, a second-degree felony punishable by up to 20 years in prison.
“He crossed the line from dirty politics to commission of a violent crime, and we are lucky no one was killed,” Harris County District Attorney Kim Ogg said. “His alleged investigation was backward from the start – first alleging a crime had occurred and then trying to prove it happened.”
According to court documents, Aguirre told police that he was part of a group of private citizens called the “Liberty Center,” who were conducting a civilian investigation into the alleged ballot scheme.
According to Aguirre, he had been conducting surveillance for four days on a man who was allegedly the mastermind of a giant voter fraud scheme. Aguirre told authorities the man was hiding 750,000 fraudulent ballots in a truck he was driving.
Instead, the victim turned out to be an innocent air conditioner repairman, court documents said.

The Survey of the Performance of American Elections (SPAE) provides information about how Americans experience to voting in the most recent federal election. Conducted in every presidential election since 2008, the SPAE is the only national survey of election administration that focuses on the process of voting, and provides insights into the performance of elections in the individual states.
In 2020, 18,200 registered voters responded to the survey, which was administered by YouGov. Two hundred respondents each were interviewed in 40 states plus the District of Columbia. 1000 additional interviews were conducted in the states of Arizona, Florida, Georgia, Iowa, Michigan, Nevada, North Carolina, Ohio, Pennsylvania, and Wisconsin. The 2020 SPAE was supported, in part, through the generosity of the Democracy Fund.
This document provides an initial look into some of the findings from the survey. A more detailed report, along with a release of the data set, will follow in February 2021.

Senate Majority Leader Mitch McConnell<https://thehill.com/people/mitch-mcconnell> (R-Ky.) is urging Republicans not to object during Congress’s count and certification of the Electoral College vote next month.
McConnell’s comments were made during a caucus call on Tuesday, according to a source familiar with the call, and come as House Republicans are eyeing a challenge to the results on Jan. 6 during a joint session of Congress.
A Republican senator who participated in the call said that McConnell, Senate Republican Whip John Thune<https://thehill.com/people/john-thune> (R-S.D.) and Senate Rules Committee Chairman Roy Blunt<https://thehill.com/people/roy-blunt> (R-Mo.) all urged colleagues not to object to states’ electoral votes when they are received on the House floor next month.
McConnell warned that any GOP senator who signed onto a House Republican objection to a state’s electoral votes would then force the Senate to debate and vote on the objection, putting fellow GOP senators in a bad position.
The GOP leader said an objection “isn’t in the best interest of everybody.”
No Senate Republicans indicated during the call that they are currently planning to object.

Judge Kevin White also said former Gilbert Public Schools Board President Staci Burk had waited too long to file her complaint, and allowing it to proceed would “circumvent the strong public policy supporting prompt resolution of election cases.”
Burk filed the case Dec. 7, seven days after state officials certified Arizona’s Nov. 3 results. Voters have a five-day window to bring election contests.
Her claims closely mirrored those in another suit that was making its way through federal court at the time: Both alleged “massive election fraud” in Arizona involving Dominion voting machines, foreign interference and illegal votes, and both named Secretary of State Katie Hobbs and Gov. Doug Ducey as defendants.

The name of the mystery donor behind a $550,000 effort that helped promote no-party candidates in three key Florida Senate races, including one that is under investigation, was changed in campaign finance reports over the weekend.
While making changes to fix errors in campaign finance reports is common, election attorneys, say it is unusual to see political committees change the name of their sole donor two months after the fact.
Even so, two political committees — Our Florida and The Truth — amended campaign filings and changed the name of the entity that funded the political mailers from Proclivity to Grow United Inc., a tax-exempt corporation that is also registered in Delaware and whose address is a post office box in Denver.
Unlike Proclivity, however, Grow United Inc. has made other donations in Florida politics, including to the Florida Democratic Party and other affiliated committees, including the one that led Senate Democratic campaigns.
The amount and date of the donations to the political committees that purchased the political mail are identical. Treasurers who update information on their campaign finance records are doing so under oath.
“The Division of Elections allows a political committee or candidate to amend reports in order to fix errors,” said Natalie Kato, a Tallahassee-based elections and campaign finance attorney. “However, completely changing the sole donor to a political committee after the election is arguably not in the spirit of the law, and could be the basis of a complaint.”…
The mystery donor has been the focus of a dark money mystery during the 2020 election cycle.
Its$550,000 in untraceable contributions to the political committees funded political mailers that were sent to voters in Senate Districts 9, 37 and 39 in the month leading up to the Nov. 3 election. The ads talked up no-party candidates that did no independent campaigning as ones with progressive ideals in an apparent attempt to reach Democratic voters and divert some votes from the Democratic candidates in those races.

For those following donor-privacy issues, there was an important development in the case known as Americans for Prosperity Foundation v. Becerra<https://www.scotusblog.com/case-files/cases/americans-for-prosperity-foundation-v-becerra/> in mid-December. The current status of this litigation is that the plaintiffs have petitioned the U.S. Supreme Court to take up the case for review, challenging the decision from the Ninth Circuit, which ruled against the plaintiffs. There have been 22 amicus briefs filed in support of AFP et al.’s petition for writs of certiorari, including one<https://www.philanthropyroundtable.org/docs/default-source/default-document-library/afpf-v-becerra-9th-circuit-court-of-appeals-1-30-17.pdf?sfvrsn=dbaaaf40_2> from The Philanthropy Roundtable.
The question before the court? “Whether California’s requirement that charitable organizations that fundraise in the State disclose to the state Attorney General’s office the identities of their substantial contributors violates the constitutional freedom of association.”
In considering this petition, the Court asked the Solicitor General what the federal government’s position is on this question. After a long wait, the Solicitor General has now issued that opinion in his own amicus brief<https://www.justice.gov/sites/default/files/briefs/2020/11/24/19-251acunitedstates_page_proofs.pdf>.
