How do we keep a situation like the one in Patterson NJ from being the November through December all-consuming story in the US presidential election?


  1.  We could think seriously about ways to make sure that vote by mail has the highest possible reliability and validity.  Voters have less faith in vote by mail than traditional voting and with good reason given the additional ways something can go wrong (whether through fraud or mischance) and the greater likelihood that the voter will not be able to correct something going wrong in a vote-by-mail scenario.

How we will instead do it:

3. Spend the next four months digging deeper partisan trenches and denying any possibility of authentic concerns by those on the other side of the no man's land, getting things ready for the possible disaster scenario to be as bad as possible.

Perhaps at some point more partisans will realize that extreme partisan warfare is a negative sum game and find a way to reach a better settlement, but this seems unlikely to happen for some time to come.

Having yet to find an effective formula for undercutting Mr. Biden or to lure him into the kinds of culture war fights that the president prefers, Mr. Trump is training more of his fire on the political process in a way that appears intended to give him the option of raising doubts about the legitimacy of the outcome.

But in recent days, Mr. Trump has focused intensive new attacks on voting by mail, as states grapple with the challenge of conducting elections in the middle of surging coronavirus cases in many parts of the country.

On Tuesday, Mr. Trump declared, without offering any evidence, that the 2020 election “will be, in my opinion, the most corrupt election in the history of our country, and we cannot let this happen.”

Mail-in ballots, he said, referring to conspiracy theories, could be stolen from carriers, counterfeited or forged by either forces inside the United States or by “foreign powers who don’t want to see Trump win.”

Over the last few months, states across the US have seen record numbers of their voters cast their votes by mail as states expand and encourage its use during Covid-19. It’s a change that means election officials are going to need more time to count votes as ballots flood election offices on election day and afterwards – some states count ballots postmarked by election day if they arrive in the days after the election.

There are worries about how the US will react to delayed results during November’s hotly contested presidential election. Americans are used to the spectacle of election night – anchors on major networks breathlessly analyze and call races and the evening culminates in a late night speech from victorious candidates. That’s very unlikely to happen this year – Americans are going to be waiting a while to find out whether or not Donald Trump will be president for another four years.

“The delays during the primaries in getting election results can teach the media and voters a valuable lesson: processing and counting absentee ballots takes more time than tabulating in-person votes,” said Richard Hasen, a law professor at the University of California, Irvine who specializes in elections. “The public, despite the inevitable angst over the results of November’s election, needs to be prepared for the media to say that the presidential race is ‘too early to call’ if it is close in the electoral college.”

Indeed, as long as in-person voting can be made reasonably safe and efficient, we should take every step to assure voters they have an in-person voting option — and to encourage them to use it. Failing to do so could lead to major problems.

Tasking election officials with preparing for high levels of absentee voting, while also ensuring capacity for strong in-person voting, is a tall order. If one candidate is ahead in key states on the night of the election, but loses those leads — and the race — over the course of the following week, charges of a stolen election will inevitably erupt. . . .

If Congress’s contribution is focused on providing funding to enable in-person voting, bipartisan support might be possible. In Kentucky, a coalition of Republican legislators and minority voters sued, unsuccessfully, to force the state to open more in-person sites. Most importantly, election officials, as well as campaigns, must not suggest that absentee voting is the only safe way to vote; that will not only deluge the absentee process but also depress turnout among groups who only trust voting in person.

The more people who vote in person, the sooner the result will be known, the less the risk that the absentee process will collapse, and the lower the threat that the election will melt down. We must not lose sight of that danger, even as states rightly ramp up the absentee part of the election.
