Doesn't the Presidential Succession Act simply mean that Nancy Pelosi (if she's willing to resign from Congress) gets sworn in?  It's clear that Donald Trump's term ends at noon.

If the two houses of Congress cannot meet the constitutional requirement of verifying the Electoral College vote by Jan. 20, can the new President be sworn in? In other words, if actions such as what we are seeing now and similar actions succeed in preventing the congress from fulfilling its duty can that prevent the new President from taking office because the casting of Electoral College votes is not accomplished.

After Republican victories in 2000, 2004 and 2016, for instance, Democrats in Congress used the formal counting of electoral votes as an opportunity to challenge election results.

But the history of Democratic efforts to contest the outcomes of presidential elections is not a history worth emulating. On the contrary, it only underscores that the certification of a president-elect's victory by the House and Senate is an improper forum for the airing of political grievances and an inappropriate occasion to readjudicate the decisions of the states concerning things like vote tallies, recounts and audits.

While Congress has the power to decline to count electoral votes, it has done so only in extreme situations in the aftermath of the Civil War - when, for instance, a state was deemed to lack a functioning government. The Electoral Count Act of 1887, which sets the rules for Congress to count electoral votes, was enacted with the presumption that state procedures are trustworthy. The act instructs Congress to defer to state judgments when a state resolves controversies over the appointment of electors.

The act also requires broad political consensus to decline to count electoral votes. It instructs that on Jan. 6 after a presidential election, the president of the Senate (typically the vice president) presides over a session of the two chambers. If a member of Congress wishes to object to counting a state's electoral votes, a member of the House and a member of the Senate must sign a written objection. The chambers separate for up to two hours of debate. If majorities of both chambers agree to the objection, the objection stands. If not, the votes are counted.

The House and Senate will convene Wednesday afternoon for a remarkable joint session to formalize President-elect Joseph R. Biden Jr.'s Electoral College victory, with President Trump and his allies plotting to transform the counting session into one final, futile attempt to overturn the results.

Bipartisan majorities in both chambers are prepared to meet late into the night to beat back the challenges and confirm Mr. Biden as the winner. But by using what is typically a ceremonial proceeding as a forum for trying to subvert a democratic election, Mr. Trump and his allies are going where no party has since the Reconstruction era of the 19th century, when Congress bargained over the presidency.

Its implications, for future elections and the Republican Party, could be significant.

At least four Republican senators - Ted Cruz of Texas, Josh Hawley of Missouri, Kelly Loeffler of Georgia and Tommy Tuberville of Alabama - have agreed to join House members to challenge the results of three battleground states Mr. Biden won: Arizona, Georgia and Pennsylvania. Senators were still weighing whether to join House members to similarly challenge the outcome in Michigan, Nevada and Wisconsin.

In each case, their objections will force the House and Senate to debate Mr. Trump's baseless claims of election fraud for up to two hours and then vote whether to accept or reject the results certified by the state. A process that typically consists of less than an hour of glorified paperwork could take anywhere from nine to 24 hours, starting at 1 p.m. Eastern.

In the closing days of his presidency, Donald Trump has demonstrated that he can make innumerable false claims and assertions that millions of Republican voters will believe and more than 150 Republican members of the House and Senate will embrace.

"The formation of public opinion is out of control because of the way the internet is forming groups and dispersing information freely," Robert C. Post<https://law.yale.edu/robert-c-post>, a Yale law professor and former dean, said in an interview.

Before the advent of the internet, Post noted,

People were always crazy, but they couldn't find each other, they couldn't talk and disperse their craziness. Now we are confronting a new phenomenon and we have to think about how we regulate that in a way which is compatible with people's freedom to form public opinion.

Trump has brought into sharp relief the vulnerability of democracy in the midst of a communication upheaval more pervasive in its impact, both destructive and beneficial, than the invention of radio and television in the 20th Century.

In making, embracing and disseminating innumerable false statements, Trump has provoked a debate among legal scholars over whether the once-sacrosanct constitutional protection of free speech has itself become a threat to democracy by enabling the widespread and instantaneous transmission of lies in the service of political gain.

Change is urgent to deal with election pathologies caused by the cheap speech era, but even legal changes as tame as updating disclosure laws to apply to online political ads could face new hostility from a Supreme Court taking a libertarian marketplace-of-ideas approach to the First Amendment. As I explain, we are experiencing a market failure when it comes to reliable information voters need to make informed choices and to have confidence in the integrity of our electoral system. But the Court may stand in the way of necessary reform.

Those challenging the viability of applying free speech jurisprudence to political speech face a barrage of criticism from legal experts who contend that the blame for current political crises should not fall on the First Amendment.

This is the topic of my book manuscript in progress, Cheap Speech.

The COVID-19 pandemic has challenged American democracy. In 2020, the pandemic affected every aspect of the American electoral system-from the way candidates run campaigns, to the way states run elections, to the way citizens cast their ballots. The Section's annual panel this year will discuss how the states and the federal government navigated the democratic challenges that the COVID-19 pandemic created and how the states sought to ensure that the citizens could safely cast their ballots. The panelists will discuss the new voting rules that were created in response to the pandemic, some of the litigation that ensued, and how the pandemic influenced the outcome of the presidential election in November .
