If a court announces—with liberals and conservatives all on board—an “exacting” standard, and liberal justices then interpret it in a manner similar to “rational basis,” and then conservative justices demand that when they or their predecessors agreed to “exacting,” they really did mean “exacting,” just Who committed the ole “switcheroo?”

In a 6-3 opinion<https://linkprotect.cudasvc.com/url?a=https%3a%2f%2fwww.supremecourt.gov%2fopinions%2f20pdf%2f19-251_p86b.pdf&c=E,1,czywq_MoIW2w-bnHnVN6SJ5vI0aJ-7Fsw-N2fQbzDQJREjW7Xq0S4I-lLdx1PGVBoLhINVH-AS4XuQgIRMQi9qs74Y4M6fPeDsL6G1HsnpVNOR8JsuZm&typo=1>, the Supreme Court has stuck down on a facial challenge California’s law requiring disclosure of donor information to CA officials for law enforcement purposes. But the case has major implications for campaign finance disclosure rules.

Justice Sotomayor in dissent says “Today’s analysis marks reporting and disclosure requirements with a bull’s-eye” and she’s exactly right. Chief Justice Roberts for the Court does the exact switcheroo <https://linkprotect.cudasvc.com/url?a=https%3a%2f%2felectionlawblog.org%2f%3fp%3d122908&c=E,1,90Y4Myt03YXf3sWvzcWM992osQedsOSwhojt0EzSeZQ0HWtiR7dKdbvVumVcps3VEWjZPmIomp3fGCKol5Lika1bF-CC81EHJq_6noMbxRPCaH7nORQ,&typo=1> on what “exacting scrutiny” means as he did<https://slate.com/news-and-politics/2014/04/the-subtle-awfulness-of-the-mccutcheon-v-fec-campaign-finance-decision-the-john-roberts-two-step.html> in McCutcheon in the contributions context.

More later, but the key point is that it will be much harder to sustain campaign finance disclosure laws going forward.
