[EL] question about Bush v Gore

US Senator Joseph Lieberman's book "The Centrist Solution" (published 2021) says on page 127 that Al Gore phoned him December 12, 2000, to tell him that the US Supreme Court had ruled against their ticket in Bush v Gore. But Lieberman also writes that Gore told him in the same phone call that "the Court had left open a door for us to go back to the Florida Supreme Court and ask for a statewide recount."
After reading that page in Lieberman's book, I then re-read Bush v Gore and I don't see that, although I didn't read the opinion very carefully. The controlling opinion seems to say that time was up because Dec. 12 was the "safe harbor" date. Can anyone shed some light on this?
Incidentally, Lieberman's book also says that Lieberman said to Gore that they should go back to the State Supreme Court, but of course Gore did not do that.
