Harper's Magazine (the illustrious journal that has covered American
culture since the mid-nineteenth century) this month includes a fun,
insightful dialogue between Pam Karlan (the illustrious law professor
and fellow list member who has covered voting rights since the
mid-nineteen eighties) and Richard Posner (illustrious judge who has
covered just about every major legal issue to arise since the
nineteenth century).
The exchange is on the Supreme Court's role in deciding the contested
presidential election. Karlan and Posner finish each other's
sentences, take a few pointed shots at one another, and offer plenty
of astute observations about the controversy. Posner defends (on
Article II and pragmatic grounds) and Karlan attacks (on standing and
equal protection grounds) the Court's decision in Bush v. Gore.
