Local Republicans filed a lawsuit in federal court yesterday in an attempt to block the recently approved reapportionment of Allegheny County Council districts.<P>
The council's Democratic majority approved new district boundaries in a surprise vote Aug. 23, creating a map that will put Republicans at a disadvantage in elections for the next 10 years.<P>
The new boundaries, approved without public input, place two Republican council members in the same district and another GOP member in the same district as a Democratic incumbent. Thus, the possibility exists that the number of Republicans on the 15-membe
r council would drop from five to three after the 2003 elections.<P>
The lawsuit -- filed by the Republican Committee of Allegheny County, the boroughs of Churchill and Bellevue, and nine registered voters -- complains that the new map violates the federal Voting Rights Act and several other laws.<P>
According to the Republicans' complaint, the percentage of African Americans in County Council District 10 drops from the current level of 62 percent to 58 percent in the new map. <P>
The Voting Rights Act provides that districts can be drawn in ways that maximize the potential for minority representation.<P>
The lawsuit, filed Downtown in U.S. District Court, also alleges that the new map disenfranchises 108,571 residents until 2005. <P>
That is the number of residents who, under the new map, are being shifted to districts where the council term expires in 2005 instead of 2003.<P>
In addition, the lawsuit claims that the map violates the county's administrative code by dividing the city of Pittsburgh into six districts instead of the minimum number of four and violates the state Sunshine Act because Democrats did not provide public
notice before voting on the reapportionment.<P>
Councilman Tom Shumaker, R-Pine, said the reapportionment is an embarrassment.<P>
"I do believe the reputation of this [council] has been significantly tarnished," he said.<P>
But Councilman Wayne Fontana, the map's author, expressed confidence that the map will survive the Republicans' legal challenge.<P>
"It meets all the criteria that a redistricting plan is supposed to meet," said Fontana, D-Brookline. "I view [the lawsuit] as political grandstanding by the Republicans. It's just their way to put out more propaganda because it's election time and they'r
e just trying to draw attention to themselves."<P>
In approving the map on Aug. 23, the Democrats circumvented a reapportionment process of their own making.<P>
Council President John DeFazio, D-Shaler, had selected Fontana to chair a 15-member reapportionment committee made up of each council member or his or her designee. <P>
But after the committee had met just twice, Fontana aborted the process and presented a map of his own for council approval.<P>
Fontana said he drew the map in the hours before that Aug. 23 meeting, after huddling behind closed doors the night before with former state Sen. Edward Zemprelli and Duquesne University law professor Joseph Sabino Mistick, two Democrats with expertise in
reapportionment.<P>
Fontana said he chose to act in such a rush out of fear that the Republican-controlled state Legislature would attempt to take the reapportionment out of council's hands. <P>
Legislation proposed by county Chief Executive Jim Roddey that would have shifted control of the redistricting process to a bipartisan five-member commission was approved in the Senate last June but fell just one vote shy in the House.<P>
The new map puts Republican council members Jan Rea of McCandless and Shumaker in District 2, and it shifts Mike Crossey, D-Mt. Lebanon, into District 5, where a Republican, Vince Gastgeb, is the incumbent.<P>
Francis said his own calculations show that the new map creates two safe seats for Republicans -- District 2 in the North Hills and District 5 in the South Hills -- and creates three competitive districts. <P>
Under the existing boundaries, Republicans are a minority in each of the 13 districts, but differences in party registrations are small enough in seven of the districts to make them competitive, by Francis' count.<P>
Three days ago, council Republicans put forth a proposal to rescind the new map and reopen the reapportionment process, threatening to sue if the Democrats didn't cooperate.<P>
Yesterday, the Republicans followed through on their threat.<P>
Reapportionment is required every 10 years, after the U.S. Census, to keep population levels roughly equal in each district. <P>
Allegheny County Council has 13 districts and two members elected at large.<P>

<p>WASHINGTON (AP) -- The Census Bureau is nearing a decision on whether =
to use adjusted census figures to help dole out some $185 billion in fede=
ral assistance to states and cities.</p>
<p>The federal government uses population-based formulas to distribute th=
e money to Medicaid, foster care and other social service programs. Essen=
tially, the more people a place has, the more money it is eligible for.</=
p>
<p>Bureau officials must determine whether statistical sampling produces =
more accurate population figures than the raw head count available now.</=
p>
<p>Most Democrats and civil rights groups say it does, specifically for m=
inority groups and inner-city residents typically missed by the head coun=
t.</p>
<p>Generally, Republicans contend adjustment could create more mistakes i=
n the 2000 census, which had a lower net national undercount than 1990's.=
</p>
<p>The bureau was originally to issue a recommendation next week to Comme=
rce Secretary Don Evans, who would make the final decision. Commerce over=
sees the Census Bureau.</p>
<p>On Friday though, bureau officials said Evans delegated that decision =
to Acting Census Director William Barron. Evans is scheduled to be in Rus=
sia next week for his first foreign trade mission.</p>
<p>A committee of senior census staffers will now issue a recommendation =
Monday to Barron. Barron is scheduled to announce his decision Wednesday.=
</p>
<p>``The question is, can you use the (adjusted data) to help improve the=
count,'' Barron said.</p>
<p>The Bush administration faced the same question earlier this year befo=
re recommending against using adjusted data to redraw congressional, stat=
e and local political districts.</p>
<p>The bureau then cited too many discrepancies between the sampled figur=
es, the raw count and a third set of data used to measure accuracy, and s=
aid it had too little time to study the issue.</p>
<p>Evans, who had the final say for the initial decision, agreed. It clea=
red the way for only the raw head count to be used for redistricting.</p>=
<p>``Adjusted data is the only way to get a fair and accurate count,'' sa=
id New Orleans Mayor Marc Morial, president of the U.S. Conference of May=
ors.</p>
<p>``The failure to adjust will just create another decade of suspicion a=
bout the accuracy of the numbers of people who live in these cities,'' Mo=
rial said. An undercount deprived New Orleans of up to $60 million in fun=
ding over the 1990s, he added.</p>
<p>Bureau officials have said further research indicates they made the ri=
ght decision earlier this year. Overall, the Census Bureau has estimated =
fewer Americans were missed this time than in 1990. Undercounts for most =
minority groups were also lower.</p>
<p>In most cases, however, there were still higher undercount percentages=
for minority groups than for non-Hispanic whites.</p>
<p>Earlier this week, the National Research Council said the 2000 count w=
as ``well executed in many respects,'' including advertising and the rede=
signed questionnaires.</p>
<p>But the report also noted problems with address lists, and questioned =
the counting of some 1.2 million people at addresses without information =
about the size of the households or whether the homes were even occupied.=
</p>
<p>Democrats have said not correcting undercounts would leave states and =
cities with large minority populations shortchanged on funding. According=
to some Republicans, sampled data would create ``virtual people'' and fa=
il to place people who were missed in the neighborhoods where they actual=
ly lived.</p>
