<p>ALBUQUERQUE, N.M. (AP) -- A judge rejected a redistricting proposal We=
dnesday that would have created a Hispanic-majority congressional distric=
t for New Mexico, and instead approved a plan that makes only slight chan=
ges.</p>
<p>The ruling was a setback for the Democrats, who had hoped a dramatic r=
ealignment and Hispanic-majority district would give them a better shot a=
t a second U.S. House seat. Republicans now hold two of the state's three=
seats.</p>
<p>Democrats had argued that the state's large number of Hispanics -- 42 =
percent of the state's population -- should be given a greater voice in C=
ongress.</p>
<p>However, District Judge Frank Allen Jr., a Democrat, said he found ``n=
o persuasive evidence'' the federal Voting Rights Act required a Hispanic=
majority district.</p>
<p>``This court is and should be reluctant to make radical or partisan ch=
anges, unless the law requires these changes to be made,'' he wrote.</p>
<p>New Mexico's redistricting, required every 10 years by law, ended up i=
n court because the Democratic-controlled Legislature and Republican Gov.=
Gary Johnson were unable to reach an agreement during a special session =
in September. Several groups sued, asking the court to intervene.</p>
<p>Joseph Goldberg, an attorney for a group of Democrats, said no decisio=
n had been made whether to appeal.</p>
<p>State Sen. Ben Altamirano, a Democrat, said the ruling was a setback f=
or attempts to give Hispanics a bigger voice in politics.</p>
<p>``I ran for Congress at one time, and had I had a more representative =
district, I may have had a better chance for winning,'' he said.</p>
<p>Overall, the plan moves 22,966 people, or just 1.2 percent of the stat=
e's population, into new districts. The percentage of voting-age Hispanic=
s in the three districts remains nearly the same -- 38.8 percent, 42.5 pe=
rcent and 34.6 percent.</p>
<p>Don Bruckner, a lawyer for the Republicans whose plan Allen approved, =
said it would preserve one district in northern New Mexico that is strong=
ly Democratic and two swing districts, currently held by Republicans, tha=
t could tilt either way.</p>
<p>``The court decided to leave it the way it is, which we felt was appro=
priate,'' he said.</p>
<p>Matthew Hoyt, a lawyer for the governor, said Johnson believed the pla=
n Allen adopted made the most sense for the state. ``It does a good job o=
f maintaining political competition,'' he said.</p>
<p>New districts are drawn every 10 years after Census figures are releas=
ed. Unlike many other states, New Mexico did not lose or gain any seats i=
n Congress, but a new map was needed anyway to reflect population shifts =
within the state.</p>
<p>The head of the state's Democratic party expressed disappointment Wedn=
esday in Allen's decision.</p>
<p>``We thought it was the right thing to do for New Mexico to create suc=
h a district,'' said David Gomez, the interim state party chairman. But, =
he added, ``We'll take what we've got, run with it and win.''</p>

Subject: Watchtower case and campaign finance disclosure
As many of you know, the Supreme Court will hear oral argument on Feb.
26 in Watchtower Bible and Tract Society v. Village of Stratton (No.
00-1737). The Court has agreed to consider whether one has a right to
engage in anonymous door-to-door advocacy of political or religious
causes.
The case may have implications for the Supreme Court's jurisprudence
related to the constitutionality of campaign finance disclosure laws;
the cert petition in Watchtower relied upon the important McIntyre
campaign finance case.
I co-authored an amicus brief with attorneys from the Brennan Center for
Justice arguing that the Court should use the case to clarify that most
campaign finance disclosure laws are constitutional. Anyone who wishes

An organization called "Realcampaignreform.org" also filed an amicus
brief, but it does not seem to be available on the organization's
website. The organization appears to be one that would oppose campaign
finance disclosure laws. (Other organizations filed amicus briefs as
well, though none with obvious campaign finance interests. The Supreme
Court docket in the case is accessible at:
