<p>BOSTON (AP) -- Massachusetts' highest court ordered the Legislature on=
Friday to provide the money needed to put into effect the state's clean-=
elections law, which offers tax dollars to candidates who agree to limits=
on both their spending and their fund-raising.</p>
<p>Voters approved the clean-elections law 2-to-1 in 1998, but the Legisl=
ature has refused to release the necessary money.</p>
<p>In a 5-2 ruling, the Supreme Judicial Court said Friday that as long a=
s the law remains on the books, the Legislature has a duty under the Mass=
achusetts Constitution to provide the money needed to carry it out.</p>
<p>That means the law will go into effect with the current 2002 election =
cycle, which will include a governor's race.</p>
<p>``I'm on Cloud 9,'' said Warren Tolman, a clean-elections candidate fo=
r governor whose campaign was running out of money as he awaited the high=
court's ruling. ``It's a huge victory for us, it's a huge victory for cl=
eaning up the corrupt campaign finances in Massachusetts.''</p>
<p>Massachusetts has a clean-elections account containing $23 million. Bu=
t because of the Legislature's resistance, the money sits untouched.</p>
<p>One of the strongest critics has been Democratic House Speaker Thomas =
Finneran, who said the state cannot afford public campaign financing.</p>=
<p>Republican acting Gov. Jane Swift, who is seeking election in her own =
right, supports the law and has proposed a state budget that would releas=
e the money. However, she does not plan to run as a clean-elections candi=
date and accept the limits on fund-raising and spending.</p>

This week the U.S. Supreme Court summarily affirmed the judgment of the
three-judge federal district court in Robertson v. Bartels, 148 F. Supp. 2d
443 (D.N.J. 2001), one of the cases challenging New Jersey's 2001
legislative redistricting plan. Norman M. Robertson, a white Republican
state senator whose district was redrawn to raise its black voting-age
population from 3.9% to 35.3%, filed suit last spring, claiming that the New
Jersey Apportionment Commission had violated the Equal Protection Clause by
protecting all minority incumbents, but not all white incumbents. The
three-judge district court unanimously rejected his argument as a matter of
law and granted summary judgment in favor of the defendants, and this week
the Supreme Court summarily affirmed that decision. In the meantime,
African-American Democratic Assemblywoman Nia Gill defeated Senator
Robertson in the new senate district, 65% to 34%, as Democrats recaptured
control of the New Jersey Legislature. Republican plaintiffs had filed an
earlier challenge to the same redistricting plan, Page v. Bartels, 144 F.
Supp. 2d 346 (D.N.J. 2001) (three-judge court), under Section 2 of the
Voting Rights Act. That challenge also failed, and the plaintiffs dropped
their appeal last summer after minority candidates won several key
Democratic primary elections in districts that were not majority-black.
