of CFInst.org/eGuide, the Campaign Finance eGuide, offering
nonpartisan analysis of the Shays-Meehan and Ney-Wynn campaign
reform bills.
The CFI eGuide is an Internet-based policy tool to enable
congressional staff, reporters, and policy professionals to
sort through the details of pending campaign finance legislation.
It was designed to be user-friendly and accessible, while also
thorough in covering the details of this complex topic.
The eGuide website, http://www.CFInst.org/eGuide, allows users
to navigate the site by bill or by topic; it will also include
an "FAQ" section addressing what the bills mean in practical
terms. We urge you to check the website itself, which will prove

version.
The Campaign Finance Institute is a nonpartisan 501(c)(3)
organization dedicated to conducting research and deliberations

The Speaker's Commission on the California Initiative Process released its
final report last night at a panel discussion at the Commonwealth Club.
The report should be up on the website (http://www.cainitiative.org/) soon.
The panel included David Broder, Mark Baldassare, and Speaker Emeritus
Hertzberg. The discussion was broadcast on the radio and may be available
on the Club's website.

I wonder if the lack of a good factual record in Buckley was related to
the fast-track judicial review provisions for the statute under review
there. The McClain-Feingold bill, as I recall, has a similar though not
identical fast-track provision--any suit will be in federal court in DC,
with direct review by the Supreme Court.

One of the issues currently being debated about the
Shays-Meehan bill in the House is whether it should apply to
the current election cycle. As currently written, the
bill's soft money ban would take effect 30 days after the
bill would be signed. Some have suggested the bill be
amended to apply first to the 2004 elections.
Besides avoiding the confusion of changing the rules in
midstream, one less obvious benefit of delaying the bill's
effective date until the 2004 election is that it would give
litigants who will challenge and defend the bill in an
inevitable court challenge a chance to develop a good
factual record. A good factual record was missing when the
Supreme Court rushed through its decision in Buckley v.
Valeo in 1976.

The judge threw out the results of this mayoral election in a small
Southern California city and, more surprisingly, ordered the former
incumbent declared the winner, based solely upon the testimony of Ohio
State social scientist Jon Krosnick. Krosnick is an expert on the effect
of ballot order on electoral outcomes. He testified that the placement
of one candidate's name over the other (in violation of state law,
according to the analysis of the judge), gave that candidate a 306 to
354 vote advantage.
Has anyone else on the list heard of a case where a judge used ballot
order to reverse the results of an election (as opposed to ordering a
new election, or more commonly, issuing an injunction requiring some
rotation or randomization of candidate names)?
In the interest of full disclosure, I consulted for the City of Compton
on this case.

<p>LOS ANGELES (AP) -- A judge threw out the results of last summer's Com=
pton mayoral election Friday and declared incumbent Omar Bradley the winn=
er.</p>
<p>Superior Court Judge Judith Chirlin upheld allegations of fraud and ot=
her problems made in a lawsuit filed by Bradley, who lost to Eric Perrodi=
n by 261 votes last June.</p>
<p>Chirlin determined last month that precinct workers had mishandled bal=
lots. At the time, however, she said the problems did not affect the outc=
ome of the election in the blighted suburb southeast of Los Angeles.</p>
<p>During a 10-week trial that included 85 witnesses and more than 100 ex=
hibits, attorneys contended that more than 140 illegal votes were cast, s=
ome by undocumented workers, and that voters were misled and sometimes ha=
rassed.</p>
<p>Perrodin's attorney argued that there was not enough misconduct to con=
clude that the election's results should be overturned.</p>
<p>The judge had previously ruled that City Clerk Charles Davis failed to=
supervise the election properly. Among the problems were missing tallies=
of voters, missing precinct worker signatures and a failure to find whic=
h voters received absentee ballots.</p>
<p>Last November, Davis brought 27 ballot boxes to court, saying he had s=
imply overlooked them earlier. More than 10,000 votes were cast in the ci=
ty of 93,000.</p>
<p>Compton has had its share of controversy, having seen its police depar=
tment disbanded in favor of sheriff's patrols and its schools taken over =
by the state in recent years. It has often been symbolized by gang warfar=
e and drive-by shootings.</p>
