In response to the recent comment about whether Ohio ought to fill
Congressman Traficante's seat sooner than November 2002, it's worth reading
Valenti v Rockefeller, 292 F Supp 851 (S.D.N.Y. 1968), even though that
concerned a US Senate vacancy, not US House. It's a long, scholarly
opinion. It let the New York government postpone a special election to fill
Robert Kennedy's New York Senate seat until November 1970, even though he
was killed in June 1968. Plaintiffs argued that it should be filled in
November 1968.
