Rick:  I forget how to mail to the entire listserve, so you might want to send this decision from the California Court of Appeal issued today to the list.  It holds that under California law, express advocacy must be just that in order to trigger reporting requirements and it refuses to adopt the Furgatch test as the law in California.  It will not only perhaps shake up the law here in California, but might be a harbinger of the fate that awaits McCain-Feingold.  It also will cut into Davis' campaign fund slightly, since the defendants will now be entitled to collect their attorneys' fees from his committee under the anti-SLAPP statute.
