The A.P. reporter did not make an error.  Apparently, Bopp has taken the position that he will appeal to the D.C. Circuit.  I do not understand what the theory of jurisdiction is, nor what the strategic reason might be for doing so.

Presumably, the reporter meant that Bopp may go to the Supreme Court. The three-judge court appeal goes directly to the Supreme Court.
