The 9th circuit holds a hearing in San Francisco on
June 9 in Arizona Libertarian Party v Pima Co. Bd.
Supervisors, 02-16535. The issue is whether a
political party can exclude independents from voting
in its primary. The panel will be Mary Schroeder,
Dorothy Nelson and William Fletcher. Arizona state
constitution says independents can vote in any party
primary they wish. In Arizona, primary voters not
only select nominees for partisan public office, but
party precinct committeemen as well. The lower court
had ruled that state law unconstitutional as applied
to parties that don't want independents in their
primary. 216 F Supp 2d 1007 (2002).
