Bob Bauer: The final word

Bob Bauer's final reply to Ned Foley on Foley's BCRA overbreadth article in the Election Law Journal is now posted here. The three earlier papers in the series are posted on the ELJ home page. It was a very interesting exchange.



Finally, on my post yesterday about voting in the special district election, I received a number of interesting suggestions, from "find a new wife" to vote trading ideas with other couples.  In retrospect, the simple solution is for the couple not to vote, given that the votes of each would cancel each other out.  Of course, that denies the expressive value of voting, though as I have stated elsewhere (see 88 Cal.L.Rev. 1323) these special district elections don't really have enough hallmarks of normal voting that we should worry about expressive values there.
