Today the Libertarian Party won an injunction against
a West Virginia election law, in federal court. The
law says that petition circulators (for minor party
and independent candidates) must tell everyone they
approach, "If you sign my petition, you can't vote in
the primary." McClure v Manchin, 1:3cv-205, northern
district.
In 1999 the West Virginia legislature had repealed the
law that said that voters can't both sign such a
petition and vote in the primary. But they wouldn't
repeal the law that said circulators had to say that
sentence. A state court had ruled in 2000 that the
instruction must be given.
