For those who are interested, the stay application, the state's response,
the Brennan Center's amicus brief supporting a stay, and short filings by
other plaintiffs are on our website at
http://www.brennancenter.org/programs/dem_vr_lit_session.html.
I imagine that Justice Scalia will refer the application to the full
Courrt, and that there will be a ruling today or tomorrow. The
decision will effectively determine whether this year's elections will
proceed under the map adopted by the legislature last year amidst all of
the memorable theatrics or under the map that was used in 2002.
