Sixth Circuit Panel May Not Have Last Word on express advocacy/issue advocacy decision

The Kentucky Board of Elections plans further appellate proceedings in Anderson v. Spear. (The campaign finance rulings will not be appealed.) See this A.P. report (and this report). Thanks to Ed Feigenbaum for the pointers.

The next step would be for the Board of Elections to decide whether to seek an en banc hearing before the entire Sixth Circuit or to file a petition for certiorari in the Supreme Court.

As my earlier posts indicate, I think there is a strong argument that the three-judge panel got the express advocacy issue wrong in applying the Supreme Court's decision in McConnell.
