Is Justice Kennedy now the
new swing vote on redistricting cases now that Justice O'Connor joined
with the Vieth plurality? Justice Kennedy could put some of his
consternation to the test when the Court considers Texas, Colorado,
Georgia and perhaps one of two other cases making the way up the
ladder. Vieth may just end up as one cog in a longer chain of
gerrymandering decisions yet to come down.
