May I note that how legislators take into account the Constitution, has been treated by (if I recall correctly) a major Abner Mikva piece maybe a generation ago, and I'm sure other-- I vaguely recall a book as well as other articles.  Further, even if the legislator diligently pursues constitutional concerns, there are fundamental differences of view on whether, or when, the legislator should do what s/he believes ought to serve the constitutional values, and let the courts take it from there.  Would you want a Member of Congress in 1935 to vote against the New Deal legislation because it was likely to lose in Court?  (I deliberately take a distant example.)

I am much more skeptical than Marty that even state legislators who feel duty bound to uphold the Constitution will have much problem engaging in the most partisan of gerrymanders. It is not as though Justice Kennedy's opinion gives much hope of anyone ever coming up with a standard that would satisfy him, having rejected the standards in Bandemer, the plaintiffs' standard, and the three proposed dissents' standards.
