Today (Friday) US Supreme Court Justice Anthony
Kennedy turned down a request for a stay, from a
candidate seeking access to the Republican Party
primary ballot in Alabama for State Bd. of Education.
The candidate, Kelly McGinley, had been kept off that
primary ballot by a unanimous decision of the Alabama
Supreme Court, because she had said things on her
talk-radio show critical of the Republican Party. The
lower state court had ordered her back onto the
ballot, so she would have remained on the ballot if
the Alabama Supreme Court decision could have been
stayed. The primary is June 1, 2004.
