(Limited) Coverage of Clingman Case

Other big news from the Supreme Court has crowded out Clingman. (This is par for the course. If I recall correctly, Vieth came out the same day as Lawrence v. Texas, and didn't Bandemer come out the same day as Bowers?)

Gerken and Persily Get Tenure

From the Told You So Department....

On the Election Law Blog (back on blogspot) on May 15, 2003 I posted Changing the filibuster rules? Rational Republicans will say "no". A snippet:

For these reasons, this particular "nuclear" option seems very unlikely to me. In fact, I believe threats to use it are an attempt to force the Democrats to use their filibuster power less frequently. The threat to use the strategy is very rational, even if using the strategy is itself irrational.
