Dan Lowenstein and I noticed this too in preparing the supplement to our casebook. It does not appear that the case has been submitted for publication to West. Very odd. We have published it in the Election Law Journal, at 4 Election Law Journal 231 (2005), and an appeal is now pending at the Supreme Court. You can find the opinion on Westlaw, if you search not in the allfeds database but in the jlr database (where Election Law Journal has full text coverage---or use find: 4 electlj 231).
