There is no reason for a recess appointment to reappoint Commissioner Mason. In fact, it has disadvantages. If you give Commissioner Mason a recess appointment, then it is not clear that he can stay on as an acting commissioner beyond the term of the recess appointment. If no appointment is made, he can continue serving in that seat indefinitely as an acting commissioner.
