Glenn Miller, who wants to run for US House in
southwest Missouri as a Democrat, but whose filing fee
was rejected by the Missouri Democratic Party because
of his political views, says he will file a pro se
lawsuit against the Secretary of State today (Monday)
in federal court in Springfield, Missouri.
It's an interesting case; do parties have a common-law
right to prevent candidates from filing in their own
primaries? In Missouri, there is no statutory
authority for either a party, or a state election
official, to reject a candidate filing because of the
candidate's views. In Missouri, candidates file their
declaration of candidacy and filing fee with their
party, but the check is made out to the government,
and the party merely transmits the check.
