The Texas Attorney General's brief in the DeLay
withdrawal case suggests that if a prisoner wished to
run for Congress in the state in which he or she had
been domiciled in (before being sent to some prison in
another state), that person could be kept off the
ballot. But individuals do not lose their original
domicile just because they are sent to prison in
another location. I disagree that such a prisoner
could be kept off the ballot for congress in his or
her original domicile state.
