In addition to the excellent scholarship in this issue
produced in Professor Frickey's honor, it also includes this
posthumous essay by Frickey himself, who passed away after
a battle with cancer at way too young an age. The debt that the
field of Legislation owes to him is immeasurable, and I know
from personal experience that he was a man of great kindness and
generosity to more junior colleagues.

I expect on these
facts we would have seen an Emmer concession by now. I
wonder if Emmer expects to continue having a future in Minnesota
state politics, and whether he risks that future by dragging out
the race when it seems well beyond the reach of a change in
results through a recount.
