Ben Barr, Dan Backer and I are assisting the National Defense PAC in a suit filed Monday against the Federal Election Commission.
Four months ago, the FEC failed to find four votes to approve the PAC's advisory opinion request, which is materially indistinguishable from the third issue decided by the D.C. Circuit Court of Appeals in EMILY's List. See 581 F.3d at 12.
