Hi everyone. For those interested in the question of student voting, I
thought that I would share a link to a (still early) draft of a short
paper that I have posted on SSRN. The paper arose from my involvement
in the New Hampshire student voting controversy that took place earlier
this year. If anyone has any comments or suggestions for this
election-law newbie, I am all ears.

I disagree with the assumption that this small amount of information
indicates voter fraud. A Holiday Inn can be a residence. For just one
example, hotels/motels are frequent post-foreclosure residences. And it
wouldn't be unusual for a community of people in a similar situation to
gravitate towards the same hotel/motel. If someone is living in a
Holiday Inn, does his/her right to vote depend upon whether s/he votes
again in subsequent years? Of course not.
I do not have any knowledge about the Holiday Inn in this press
release, but I am offering an alternative story that could share these
facts. However, as it turns out, there's another plausible
explanation...
"A simple telephone call to the Holiday Inn Express, where the voters
had been living, revealed the truth. The voters were college students
who were being housed at the Holiday Inn Express as their dormitory and
they were legal voters in Maine. Their medical school had been destroyed
in Hurricane Ivan and they had relocated to Maine to finish out their
classes at St. Joseph's College."

This looks like voter fraud that would have been prevented by requiring
a voter ID. It is doubtful that the people who voted for the people
registered at this hotel would have had an ID that would match the hotel

MAINE GOP UNCOVERS 19 ELECTION DAY REGISTRATIONS FROM ONE MAINE HOTEL
AUGUSTA-An examination of the statewide voter list by the Maine
Republican Party has revealed 19 individuals who registered to vote on
Election Day, November 2, 2004, using the Holiday Inn Express in South
Portland as their residence. According to the Maine GOP research, all 19
individuals registered and voted on Election Day that year and have not
voted since.

"Mainers should be very concerned that 19 individuals, who all listed
the same hotel address, were able to register to vote and cast a ballot
all on a busy Election Day. Our town clerks are already overworked on
Election Day, how can we expect them to verify that these people are
legitimate Maine residents and haven't already voted elsewhere?" said
Charlie Webster, Chairman of the Maine Republican Party.
Registration cards for the 19 hotel guests were provided by the South
Portland Town Clerk's office and can be seen here (

). All 19 cards list 303 Sable Oaks Drive, the South Portland Holiday
Inn Express, for the section titled "Street or Location Address (Where
you live)." Six of the voting hotel guests also provide the hotel room
number on the cards.
According to many of the handwritten cards, hotel guest-voters were
previously registered in states including California, Massachusetts, New
Jersey, Maryland, Oklahoma, Texas, Florida, Illinois and Tennessee.
According to the Maine Republican Party voter database, these
individuals only voted in the highly contested 2004 general election. As
of the end of August, all 19 individuals were still listed as active
voters in the Maine Secretary of State voter database.
"Our town clerks need the time and tools to make sure our elections
results are honest and every voter is an actual Maine resident. With
individual hotel-guests voting in elections, it is clear why 42 other
states have an inspection period for voter registration and do not allow
same day voter registration.
"We need to ask ourselves if someone is qualified to be a Maine voter
just because they can say, 'I stayed at a Holiday Inn Express last
night?'" Webster said.
