"Worse than Watergate; The new campaign finance order puts the
corruption of the 1970s to shame."

I have written this new Jurisprudence essa
<http://www.slate.com/articles/news_and_politics/jurisprudence/2012/07/campaign_finance_after_citizens_united_is_worse_than_watergate_.html>y
for /Slate/. It begins:

How does the brave new world of campaign financing created
    <http://www.slate.com/articles/news_and_politics/politics/2012/03/the_supreme_court_s_citizens_unhttp:/www.slate.com/articles/news_and_politics/politics/2012/03/the_supreme_court_s_citizens_united_decision_has_led_to_an_explosion_of_campaign_spending_.html>
    by the Supreme Court's /Citizens United/
    <http://www.law.cornell.edu/supct/html/08-205.ZS.html> decision
stack up against Watergate? The short answer is: Things are even
worse now than they were then.

The 1974 scandal that brought down President Richard Nixon was all
about illegal money secretly flowing to politicians. That's still a
danger, but these days, the biggest weakness of our campaign finance
system is not what's illegal, but what's legal. As Dan Eggen of the
    /Washington Post/ put it
    <http://www.washingtonpost.com/politics/post-watergate-campaign-finance-limits-undercut-by-changes/2012/06/16/gJQAinRrhV_story.html>,
"there's little need for furtive fundraising or secret handoffs of
cash." The rules increasing allow people and corporations with great
wealth to skew public policy toward their interests---without
risking a jail time, or a fine, or any penalty at all. It's an
    influence free-for-all.

Race, Voter ID, Public Opinion, and the Voting Wars

Two polls of interest today with finding that are probably related:

1. A new survey
<http://prospect.org/article/dont-blacks-youll-love-voter-id> for the
University of Delaware's Center for Political Communication finds that
those most likely to harbor racial resentment toward African Americans
are most likely to support voter id laws.

2. A new survey
<http://www.pewstates.org/research/analysis/confidence-in-the-accuracy-of-vote-counting-85899405991>
reported by Pew [corrected] finds that "More than 60 percent of whites
and Hispanics were confident that votes in their area were counted
accurately, with just over 20 percent expressing little or no
confidence. By contrast, only 44 percent of African-American respondents
expressed confidence and 33 percent expressed little or no confidence."

"The latest U.S. Supreme Court term was a little like Oscar season: The
last-minute release of the Affordable Care Act decision stole the
spotlight from some earlier attractions. A group of Supreme Court
experts put the term in perspective on July 17 during a panel discussion
at the University of California, Irvine School of Law. Beside the
opinion upholding health care reform, key decisions during the 2011-2012
term came in the areas of free speech, criminal procedure and
immigration, participants noted."

"More than half the outside spending in Pennsylvania's Senate GOP
primary race
<http://www.opensecrets.org/races/summary.php?id=PAS2&cycle=2012> was
funneled through a chain of groups that haven't disclosed the original
source of the funds. The financial gymnastics appear designed to avoid
revealing the donors behind campaign advertisements while adhering to
the letter of campaign finance law. Furthermore, a lobbyist for a
Fortune 500 energy company played a role in the scheme."

Politico <http://www.politico.com/news/stories/0712/78647.html>: "Almost
two-thirds of Americans believe corporations and unions shouldn't be
allowed to spend unlimited cash backing political candidates, according
to a poll released Tuesday. The poll
<http://www.firstamendmentcenter.org/2012-survey-public-opposes-unlimited-campaign-spending>,
done for the Freedom Forum's First Amendment Center, found 63 percent of
Americans disagreed with the Supreme Court's /Citizens United/ decision,
while 30 percent agreed and 7 percent were undecided. /Citizens United/
removed spending restrictions on corporations and unions in the name of
the First Amendment."

Here's the question and response from the survey:
